An idea....

I've been toying around with an idea for a while. I want to make a VN based on a song.
This will not be a VN centered on adult situations (pornography based) but I was thinking about making it about a devoutly religious man who dies and wakes up in a place like Hell.. There will be scenes of torture, rape, cannibalism, mental anguish...basically really fucked up stuff.
My question is... the song I want to base this off of is by an up and coming deathcore(ish?) band and I was wondering would it be plagiarism if I adapted the lyrics of the song into a storyline. I would like to use more than a few lines from the song as well...

You could always ask the band what they think of the idea? Lots of stuff is based on other stuff.

I actually just sent them a message before I hit refresh to see your comment. They're really down to earth dudes so hopefully they won't have an issue with it. Here's hoping though... I think it would make a killer story and I don't really see many VN's like what I want to do.

You can't copyright an idea, so if I was to write a book about a boy-wizard going to school I bloody well can. But if I was to title my book 'Garry Plotter and the Philosopher Stone' I might get into trademark infringement.
If you use your own words to tell the same story- you're in the clear, if you quote the original lyrics, well... you still might be in the clear under the Fair Use clause (if it's transformative enough or something -fair use is kind of fuzzy).

That's what I was wondering. There is a couple of lines from the song that I REALLY wanted to use word for word. I even want to name the VN "Oudenophobia" which is the fear of nothingness. Seeing as how it's an actual word, I figure I could use that without any issues. The main problem is the fact that I wanted to include the very intro of the song as the title music for the game, however, I believe I could work around that if I just manipulate the music a tad bit but I really respect the band a lot and I don't want to blatantly rip them off.
The idea has already started coming together in my head and I've started writing a script as well, it's in its VERY VERY rough early stages due to time (I have 2 small children, a fiance and a day job sooooo time is a valuable commodity)

I REALLY hope they reply as well. I've never played a VN like the one I have in my mind and...although the ideas I have could very well turn people off from it completely (I plan on some very disturbing imagery including rape, both male and female rape, cannibalism, necrophilia, mental and physical torture, some maiming and some super demented personalities) hopefully the story itself will be something that makes people want to keep going as well

could be cool, most bands wouldn't necessarily be psyched about having porn based on their work. A deathcore band might be the exception to this rule.

Hell the Mentors would probably be psyched and their book keeping and business is a bit too sloppy to try anything.

It isn't going to be a porn game. It's going to be a horror/thriller of sorts but with a LOT of really disturbing sexual scenes as well.

I'm interest in see how it develop, and hopfully it will.
If you ask me, I dont mind on the disturbing nature of the game, I thing it could be something fresh and interesting from others, but, what I will tell ya, is that if you care about the gamer, you will have to create paths so the gamer decides witch ones take or not, and with that in mind, how different the story or stories, could be. I think that would be pretty cool to play, and it will had more attaching with the people playing it.

Looks good, I want to see more hehe, the premiase is interesting, so I am assuming that you would create your own theory of what happens after life? sounds interesting.

Sort of. There will be "God" in a sense but there's a HUGE twist that I'm still in the process of developing.
