Hello everyone, during the past month i've been making some renders for my first game, i'm at ~500ish so far and having lots of fun while doing so, however i'm kinda worried about legal problems and copyright, here's some examples on renders i made, i dont think i'll have issues with illusion for using hs2 or with modders, but can these things like the little Nike logo on her top, the band posters, the movie, background npcs like walter white, John wick, slash and the dragon ball dude lead me to legal trouble on the long run if i start a patreon? And please dont mind the renders quality i'm still a total newbie HS2_2024-08-09-14-24-16-906.png HS2_2024-08-10-19-21-48-805.png HS2_2024-08-12-14-35-40-187.png HS2_2024-08-16-20-40-20-631.png HS2_2024-08-10-22-29-48-770.png HS2_2024-08-22-17-52-49-851.png HS2_2024-08-19-20-26-44-374.png

Nah, you'll be fine.

Rather than worrying about this risk, instead spend the same energy praying that you get a lucky chance* to become successful enough that there is a 0.1% chance that some company notices the unlicensed use of "intellectual property".

*lucky chance = be obsessed enough to spend huge amounts of time to make a high quality, large volume, consistently delivered, game output.

Theoretically, you can. In practice? Probably not. You're a small fish. They don't know you exist, and they don't care until you're big enough to disrupt their brand and/or image. And even then, there usually has to be some obvious correlation that you're presenting the IP and you yourself as being connected to the brand/image/IP/etc. itself. You aren't really worth the money it would take for them to hunt you down, serve you, and then take you to court for damages.

Your absolute worst case is a Cease and Desist/DMCA. Which basically means you'll need to stop making the game and take it down anywhere it's posted/uploaded. Typically there'll be no fines or suing. Just a scary letter from a corporate lawyer. If you proceed to make the game despite that? The chains come off, obviously. They'll bury you.

That being said, Disney and Nintendo are the exceptions here. They don't care how small someone is. They will come after you and have previously. They'll do their best to end you. But still, the worst you're likely to see is a C&D.

The ABSOLUTE worst case scenario for you is that Nike or whoever sends you a cease and desist. In that case you are obligated to remove the logos from the game...and that is it. It is only a problem if for some reason you refuse.

This is on the 0.0001% chance that actually happens. These companies have far bigger fish to fry than a hobbyist making a game. Thats before we even get into parody and fair use defense which could come in. But it won't, because you will be fine.

The actual worst case is a C&D, and then they come after you for damages. Even if they don't win, they'll keep delaying and empty your bank account + everything you made from using their IP in the process. The vast majority of Fair Use defense cases rarely win. There's nothing transformative about using an active IP in the context of porn. That's not even getting into Nintendo or Disney, either. Who are some of the pettiest you'll come across.

So, yeah. While the worst someone is ever likely to see is a C&D, it can way worse really quick.
