I had played so many adult vn games. this time I decide to making a VN with Indian characters, indian environment, cultures etc etc. I am learning the ren'py engine from Youtube. but due to lack of knowledge of laws in india I'm confuse to publish the game. my intention is not making the money from game but I want to play the game everybody around the world. You can view porn in private - but once you allow others to view it, or you intentionally circulate (for profit or not), you run the risk of opening yourself to criminal liability.
If you are truly concerned - you shouldn't ask people on the internet that you have no clue who they are, what their intentions are, and if they even give a shit about you and what happens to your life.
You should talk to an attorney in your area to assess what you can/cannot do with regard to the law and the ramifications of your actions should you decide to risk it. That way you know exactly what you risking and whether it is worth the risk before you make a decision.

You can either choose a theme you are more familiar with or create one set in a fantasy world. Shape the story to your preference and adjust it to a theme other than Indian.

Again, you should seek the advice of legal counsel near you. Do not take the word of anyone on the internet as final say. But do see that you can do some legal research yourself (I started you on your way with a link to the Penal Code of India to read). Anything beyond that, you should ask an attorney if you truly want to be informed before making a decision.
And if you don't want to make sure you won't end up like the developer in Australia who got nabbed by the police for making a game with content that is considered illegal in their country - that's up to you. But to ask for legal advice on an anonymous internet forum that is full of people who play games without compensating the developer for doing so is not the right way to make a decision that could land you in prison.
No, the person asking the question LIVES in India. They cannot legally circulate or sell anything defined as pornography while living in India. That is the problem for them. Not that they cannot create something set in India. They can create anything set in India. Anyone can. The problem is, for the person living in India, they can only use it personally - if they share it in any way, they are running the risk of criminal prosecution.
That is not what I presented in my post.
In India, an adult CAN watch porn legally - as long as they do it in private. The moment they watch it with someone else or share that porn with someone else, they can become criminally liable for doing so.
Also, porn is not proper sex education and was not what this thread is about. If you want to go down that conversation and the patriarchal hegemonic system of the pornography industry in the way it objectifies and demeans certain members of gender/social/class structures in society as well as creates false concepts of intimacy and creates opportunities for skewed schemas while at the same time reinforcing traumas of participants and validating biases, as well as a culture of drug use, etc etc - please feel free to start another thread and invite me. Legally speaking, you'll always be at risk. Even if the chances of being pulled up are miniscule, India's kangaroo courts for things like 'offending religious/cultural sentiments' are a minefield that you don't want to be caught in.
Realistically, as long as you're not going after any sacred cows (gods, prominent personalities - especially politicians and actors), the game probably won't even get noticed, since it'll be existing only in a niche subculture. After reading all replies I'm decide to stop game developing temporary. as I doing a private job and preparation for govt. exam. but this is my hobby to create a very good VN adult game if any dev want to collaborate with me it will be great.
