How come some Patreon Creators are Banned for 'Pornography' and Others Aren't?

This has confused me for a while now, which is that does not permit:
Pornography, defined as visual depictions (e.g. photos, videos) of human(s) engaging in sexual activities including but not limited to sexual intercourse, masturbation, or oral sex (e.g. genitals, sex toys, or related instruments inserted into anus, vagina, or mouth).
Which basically means that devs can't use real world pornstars in their games, right?

For example, this dev explains they were banned for that reason it seems.

But if you look right now, there's a bunch of creators, big and small, with Patreon accounts that also use real world pornstars, so I don't get it!

Is there something I'm missing? Is Patreon just inconsistent with enforcement?

They aren't reported, do you know how many creators use Patreon? I thought at first that Patreon is inconsistent with their rules, but it's just that they don't process every account. Anyway, I don't get Devs who break Patreon's rules and then complain. Real porn depict real people and it's illegal using porn stars for games, unless they gave a permission. Not to mention, Devs are charging for those games. Basically, they are earning money using images/videos of porn stars. It's bordering on rpf-real person fanfiction. Names and surnames can be coincidence but images of real people aren't. Same for AI, idk if it's possible to tell a difference whether it's a real person or AI(deep fake).

Like I have read of some creators complaining that patreon demands photographs & IDs and all kinds of things, not too mention requirements as game altering as consent must be stated not implied (so even the writing must fit into rules), so the ones on pateron have to walk a tight rope that may snap at anytime.

Yes!

There's a lot of tightrope to balance on for Patreon, but the next step is SubscribeStar, and your subscriptions take a deep dive on that platform. Patreon has a good platform with easy subscriptions and accepts credit cards easily. It even has an app because it is not just built purely around porn content.

The alternatives are less adoption friendly for the general public and discussing those charges with significant others may be more spicy to get through.

For the creators where Patreon demands photographs/IDs, do you know if they are using pornographic(real people) content in their work?

Normally they ask this to anyone who create adult content, because such say the Law in a big part of the world. And, yes, they also ask this to creators using real people, before kicking them out since, because, like pointed out by yourself, then confirm, such content is banned from Patreon...

I am not 100% sure on this but I think if you gave the game out for free but used Patreon or KoFi to take donations for support, that could work because technically you are not profiting from the game but instead you are just getting donations for being a developer and the stuff you have is free making no profit off of the real actors or videos.

The downside to this is the fact that your entire system is based on donations, but than again that isn't really any different from a streamer. It will just come down to if the stuff you make is worth people supporting you.

But once again I am not sure

Good that you're not 100% sure, because it's totally false.

Making it public is enough, even if you don't get a single buck (not even through donation) from it, and even if you would pay people to download it.
