HTML Photos/videos/real names in games

Hi everyone!

I was playing a lot of games with real porn in them and after a while I've decided that I want to make one. I've started watching tutorials for twine and then it struck me that I don't really know whether i can or cannot use pictures and names of real people. So I just wanted to ask, if i want to use these photos and names should i put some kind of source for the materials I used or no? To be clear I dont want to earn any money on this game i just wanted to create something. Also sorry for any mistakes, I'm not from English speaking country.

No matter if you make money or not it's technically illegal(unless all the images have a free license available). Any person/corporation that owns any image could shut your game down at any time. The likelihood of that happening however is very slim and if it was me I wouldn't worry too much. Putting the source down somewhere is a pretty nice way to give some credit to the actual authors, you are using their work after all, but it won't help you from a legal standpoint.

Exactly this. If you're doing this as a fun hobby thing and not to make money then you're probably not going to run into trouble, but someone could send you a Cease & Desist for using their stuff. Honestly you don't want to build your house with bricks made of other people's copyrighted intellectual property. What if you become wildly successful and suddenly all those people start to take notice of their content in your game?

Better to come up with your own stuff from the outset, imo.

Generally, we can't use photos or names of real people in a media. Even if no money is involved. Unless it's for fair use.
Example: news reporting, movie review, parodies etc.

Because basically the photo of someone must have come from a source. A photographer. So it is protected under copyright, and copyrighted to the photographer. Can't use it without the copyright holder's consent.

Another very important thing is defamation and malicious intent.
If I put Mr B's face in a photo with a comprising position or obscene position, it can be defamation and malicious intent.

You can use real names as long as it's factual and doesn't infer anything. E.G, in novel or movie you can say "Jurassic Park was directed by Steven Spielberg". But you can't use real people as characters in your story or say anything that isn't factual.

As a producer in the adult industry I let a lot of people slide when using my copyrighted material. I absolutely will not let it slide if you start trying to make money off it. I will absolutely go out of my way to put you into bankruptcy. Why? Because you know it's illegal, you know copyrights are there, you know you're stealing. It's 2021 and playing dumb isn't an excuse. I've taken people to court on the other side of the planet for violating copyright (there ARE international copyright laws as well as regional/etc)

If you want to free and clear, don't use other people's work. Make your own. Download Dazed, practice with the free version till you're good at it, invest the cash in the full version and then make your own renders. (I'm honestly not sure how gimped the free version is, if at all)

And if you happen to be some little puke in Russia who thinks that's going to save him,,,,, hope you have health insurance.
