Hello,

So I'm in the process of making a game, I was mainly doing it as a joke at first but it's starting to look serious and I don't want to spend dozens of hours of dev'ing this just to end up with something unusable, so here's my question, because if there is copyright beef anywhere it's extremely hard to track for some reason, I would assume artists would like to be vocal about what is usable but they really aren't and I'm worried ;


- Assuming I'm doing something on RPGM / Koikatsu, which is illegal to sell afaik but no one cares and neither do I.
- Assuming I'm not going around getting a bunch of cards/scenes or plug-ins everywhere, and keep a clean install.
- Should I be worried about downloading Koikatsu's content patches ? There's like 100GB worth of content in there, the KK/repack thing with the uncensor patch, bunch of backgrounds, animations etc, is all of it there because it's free to use/sell ?
- Should I be worried about anything else ?
- Don't infer any ill intent from the question, but assuming I did by mistake download some scene card or some plug-in that the artist wanted to sell, and somehow didn't find their statement, CAN THEY do anything about it or is it mostly a courtesy thing between artists ? I'm obviously not gonna grope around taking stuff that isn't mine, but being concerned about already having in my files something that could bite me later on (especially if the koikatsu patches are a no-go) is annoying.

If you use a scene or card created by an artist and sold for money, they can’t sue you. Only Illusion, the company that owns Koikatsu, Honey Select, and similar tools, could actually take legal action (and honestly, I’m not even sure they’re still active). Still, as a sign of respect, it’s important to ask for permission before using those kinds of scenes or cards. Even if the artist says no and can't legally stop you, I’d still recommend not using it out of common courtesy.

There are companies that do care about games made with tools like Koikatsu or Honey Select being sold — for example, Steam. You can’t sell games made with Illusion’s tools on platforms like Steam. I think itch.io might allow it, but I’m not 100% sure.

As for using patches and developing games this way in general — I’m not exactly sure how legal it is. Years ago, someone asked Illusion directly, and they clearly said it was illegal. But they don’t seem to actually be doing anything about it. So in the end, whether you want to take that risk or not is totally up to you.

Does the average KK or HS2 dev fully makes their own custom animations (the ones that aren't in the base engine), or do they yoink animation timelines from scene cards online and tweak it from there changing the map, characters etc ?
