Question about CC music.

Hello, I've got a question about music used in Being a DIK. I asked in this game thread but nobody answer.
Creator of this game DrPinkcake uses under "Creative Commons for commercial use" songs, that are clearly not CC for commercial use, like Sean Danielsen - Food Chain or Summertime - My Hearth.
I'm intrested in that topic, he just ask them if he could uses this songs and then use this under CC for commercial use licence? Anyone knows how this proccess go? Or what do you think?

I'm not sure about that game, but I believe that regardless of the cc if you ask to the right's owner and they say it's fine then you are safe. But a lot of people just use music they are not allowed and hope for the best, lot's of companies don't really pursue these small cases to file a suit.

Except Nintendo, they will chase you to hell and back.
