I played it till day 30 got my knowledge and charisma to level 5 and dex to level 3 and was able to max my relationship with her, but still I don't see a way to do it while she is awake

Just to throw my hat into the ring, the reason why rape isn't defined the same way across different countries is completely cultural. There's no point arguing which definition of rape is the most practical or accurate. That said, I'm in total agreement that you're not exactly a standup guy if you're molesting and sticking your dick into someone who can't consent.

I would argue that the definition doesn't change, just the scope of who needs to consent or what is deemed enough to go from sexual battery to rape. I would also argue that if you raped someone and they were unaware it happened and left no harm then i wouldn't say its morally wrong but it good go wrong very quickly. I wouldn't say that you would be a standup guy but would you not be?

I mean words literally don't translate 1:1 between languages and cultures. Like when we talk about rape in the modern English sense it's been expanded an umbrella term representing a variety of non-consensual, forced sexual contact that doesn't necessarily involve penile penetration. This isn't necessarily the case in some places.
As for your second point, just because there's no immediate consequences doesn't mean there won't ever be. The idea that you "left no harm" is contingent on 1) the victim never finding out, ever, and 2) that whatever you did never develops into a problem, neither of which are things you can guarantee. In the context of the game, you, the player, immediately start off with the ability to access videos of other people to get the idea of sleep molestation/rape in the first place. You don't know how the camera works and you can't possibly erase your evidence. How can you be certain the victim never finds out?
In the context of real life, sexual contact has a very good chance of leaving a physical mark, which can culminate in discovery. Even if the victim isn't conscious while it happens, being raped is a psychologically distressing act. If you found out one day that someone was sticking their dick in your mouth every day for weeks before someone told you, or giving you food mixed with shit, jizz, or boogers, you'd still be distressed. You'd have lasting psychological issues that'll never completely go away even with therapy.
Edit: Also, you have to also realize that the victim has nothing to gain from this. You're basically gambling on other people experiencing massive consequences for selfish enjoyment. You're not a morally good person if you think this is okay.

Interesting game, the art is good reminds me of: Night Adventure. I played just for a while, and already like what i seen. I do hope for more games like this.

If we are translating this to the real world, no.
Because the victim is not aware they are a victim, or there is "no harm done" is not "good go wrong quickly". First, if you are aware you did something wrong, you are already applying a moral value. Trying to diminish this value doesn't change it's wrong.
For your example about food, eating while some people are starving doesn't mean you are eating starving people's food. If you're old enough, you probably had parents telling you to eat your food because African children were starving. Well, those children certainly weren't going to eat the food in your plate in the first place.
Now, what you are saying, is that embezzlement, theft, and other very morally questionable activities (let's call them crimes and misdemeanors to make it easier), are not wrong as long as they are not discovered... That's quite ironic considering that most of the time, people having to defend themselves when those activities are discovered (which means when everyone discovered the harm has been done), will say they weren't in the wrong, or will try to justify themselves.
Or that victimless activates are ok. Like driving under influence or speeding. But once you enter that slippery slope, what is a victimless activity? What is a victim? It just means you can do whatever you want as long as you don't get caught. And that, usually, is not "good go wrong quickly", it's wrong period.
