Regarding Copyrights

So I recently thought of make a Adult game either using Ren'py or RPGM. When I took a note of things which I require to do, I noticed somethings which may require clarification from others.

Firstly I want to introduce myself, My name is not required. I want to make a game and that's it. I don't have any financial support to make games as full-time so it will be a part-time hobby. Mostly I will be the one doing Programming and Modelling. Since its a one man work I need to be extra careful about things I gonna do.

1. Game Assets- If I create a game using Assets released in this forum or using Models created by other Developers(making some changes) will i be subjected to Copyright law??

2.Real Porn- If I create a game using Real Porn like many QSP games, downloading GIFS,PIC and Videos and editing them and creating a game from them. Will i be in danger for using their content with out permission??

3.Illusion-Honey Select was my first option for making game, but i read a post where it stated that "ILLUSION IS GONNA TAKE ACTION ON PEOPLE WHO ARE USING THEIR GAME FOR COMMERCIAL USE" so how much of it is true?

P.S: My English is bad, So I hope you can understand what i really meant to ask.

Are those assets free to use ?
If yes (recreation 's one by example) then you can use them without problem. Else, well, you'll obviously be subjected to Copyright Laws.
This said, for this to happen they'll have to prove that you don't own the right to use the assets, what is difficult to do beforehand. Therefore, there's few risk that you'll be effectively sued for that. But the risk being low doesn't mean that you're safe, just that, until now, neither Daz3D nor the artists took actions against an indie dev for that.

Yes. Both the owner of the images/videos, the site that bought the right to use them, and the models pictured in them, can sue you for this.
It never happened (yet), because people who do that are generally too small fishes, but the risk stay.

All is wrong in this statement :
  • It wasn't Illusion but their international distributor ;
  • The said distributor only have rights over the international version, so have to prove that you haven't used the Japanese one with a third party translation ;
  • It was said more than one year ago, and we are still waiting ;
  • Illusion themselves stated that, as long as you keep the copyright notice, you are free to use their studios to generate the CG of your game.

I would add that Illusion don't really care what happen outside of Japan, so even if you don't keep the copyright notice, the risks are low. But once again, low risks doesn't mean that you are safe, just that so far it never happened.
