I'm a long time lurker, and I appreciate the helpful posts and comments and especially links! ;) So, thank you, thank you, thank you!

I'm using this post to warn Texas residents about a new bill that was passed that criminalizes (felony) the viewing of hentai and playing games like those discussed in these forums.
Look up Texas bill SB20 . I'm not allowed yet to post links, because I haven't posted enough yet. I only found this out while viewing a YouTube video from from "Otaku Spirit" titled "Controversial Texas Bill Passes - Japanese Politicians Fear Anime/Manga Impact".

Went to a secondary source and the text again relates to the production, distribution of obscene materials depicting a child.

Be careful of Youtube videos, they often want views in order to get $$$ or online clout. But I'll look what they're saying...

Right, could be wrong but it seems from the video and video comments that they are under the impression that any anime depicting a child would be banned, for example Naruto or Avatar because the characters are underage, but the specific wording is 'obscene' depiction of a child.

If i'm right and I may not be, this is a wonderful example of why people should consult those who can read legalese i.e. legal texts. (Anyone wondering I have an LLB and LLM after my name in real life.)

I'm trying to remember who else on here has legal qualifications...I know two devs do but I need to remember which ones...

And any good attorney will remind people to contact an attorney with knowledge and experience in the manner and jurisdiction for proper legal advice. Anyone simply trusting someone on an anonymous Internet forum would not be found themselves justice.

I agree, but property legal advice would not be helpful in this case.

Regarding what the bill details, the following definition in the bill (not a law, yet - Governor Abbott hasn't signed - but almost certainly will):
regardless of whether the depiction is an image of an actual child, a cartoon or animation, or an image created using an artificial intelligence application or other computer software

Would appear it could put Texas law into close alignment with US Federal law under :
a visual depiction of any kind, including a drawing, cartoon, sculpture, or painting

But, again, one should seek an attorney familiar with these matters within Texas.

Both are discussing images of obscenity, which requires a test such as the Miller three-pronged test to determine obscenity. As Icarus highlighted, this would not affect things like Naruto etc, unless an artist placed such characters into obscene situations.

Also, an LLB and LLM are all well and good for the study of the law, but not the practice as a solicitor or barrister in the UK and an attorney in the USA

Let's not put down other peoples achievements, it is useful at minimum for being able to read legal texts which is enough. And for knowing what I can and cannot do. Or how I can do the things I wish to do legally.

I am not putting down achievements. I am putting them into context. You are the one who elevated and gave the impression you practiced law - because most laypersons wouldn't know the difference. Also, anyone educated in the law should make sure to include "consult an attorney familiar with the laws/matters within the jurisdiction...."

The ability to read legal documents is a skill, but can only provide info, not advice or consultation.

I stated to consult someone who can read Legalese and that I possessed two law degrees, not at any point did I say I practiced and you will find no such specific words in any of my comments, this is a minor issue that does not need a full appointment with an attorney, merely someone able to read a text, putting this into context this is someone possibly misinterpreting the reading of a legal document, someone with that skill comes along and gives their opinion, it goes without saying with common sense that this is a porn forum not a full scope legal action that requires the consultation of an attorney. And a persons ignorance when they possess a device with all the information currently known to mankind is not my personal responsibility. Your recommendation is the proverbial going after a fly with a Bazooka, unless this somehow personally affects OP or they have a stake somehow in the effect of the Bill in terms of their livelihood or otherwise important factors, merely a reassurance as to interpretation is required.

This is beginning to form an argument, and part of the reason I rarely ever seriously comment, because people misinterpret willfully or otherwise and cannot let it lie, having to somehow 'gotcha' a person, or continue to debate and discuss, or to be the personification of the achshually meme, and no I have not specifically named you, I speak generally because I KNOW you'll latch onto it.

In Texas, playing 3DCG games that have characters that even look young will be illegal. All it takes is some angry ex peeking through your windows while you fap, or taking your computer to be repaired and the technician snoops through your harddrive. With the way Texas and Louisiana is going, they're going to start spying on internet traffic soon and title the bill "protect children on the internet bill."

Don't quote George Carlin when you don't know what you're quoting. You are completely taking Carlin out of context with this quote.

Also, the person in the video is wrong if they say federal law does not match up. Again, another reason to use critical thinking (something Carlin WAS in greatly in favor of). As shown in the information I shared with you earlier in this thread:

If you need a direct link to the Federal Statute wording. .

And no, they are not going to start spying on internet traffic. Nothing in either Federal Law or that bill even hints at such. Without a warrant or exigent circumstances - it aint happening.

However, now websites - including social media - have the option to notify both state (if in Texas) and federal authorities they are able to notify when someone posts such content, not just federal. If people you interact with on the internet sees you post such content and they are aware you live in a state with such laws, they know they can notify both state and federal authorities. (edit: and yes, anyone passing by your open window while you watch such content.... or techs working on your computer see such content on your computer... quite a few people have been caught due to the latter with regard to illegal content).

Don't be a chicken little or a henny penny.

And again, if you have no idea what the law says and it worries you - get legal advice from an attorney licensed in your area.
