Creating and Selling 3D VN Porn Game in Indonesia

As the title suggests, I want to create a 3D VN porn game and monetize it, but I live in Indonesia, which has pretty strict laws against pornographic content.
Disclaimer: I neither support, condemn, nor criticize this anti-porn law in my country or others. I just want to discuss how to deal with it.

For reference, Indonesia's anti-pornography law defines pornography as (translated from Indonesia with the help of DeepL):
"Pornography is a picture, sketch, illustration, photograph, writing, sound, voice, moving image, animation, cartoon, conversations, gestures, or other forms of messages through various forms of communication media and/or performance in public, which contains obscenity or sexual exploitation that violates the norms of decency in society."

So, by default, I wouldn't be able to make or even sell a porn game in Indonesia. But... I just want to know if it is still possible to skirt around this anti-pornography law. Is there any way to make it so that I would be able to monetize this porn content anonymously or such?

You're asking for legal advice from people who frequent an anonymous adult gaming site who specifically come here to download games without compensating the creators. Many of whom will simply tell you to just do it, don't worry about the law simply because they want more material to jack off to, and it's not their lives that would get fucked if you got caught.

Bottom line is - don't do it. Even if you find a way "to skirt around this anti-pornography law," that does not necessarily mean you won't be arrested by authorities if you are discovered. You would most likely be arrested, charged, your name published in news accounts in your community about being an accused pornographer (and possibly worse, depending upon the content of the game). Even if you were to go to court and successfully defend yourself - you're talking a lot of money for legal fees and court costs, your name dragged through the mud in the public in your area, you would lose your fulltime job, find a difficult time to find a replacement job and could lose many friends and even family connections in the process.

Also, "monetize" is the least of your worries. The average adult game creator on Patreon brings in about $100 USD per month after at least 3 years of hard work creating their content. Only 10%, again, after 3 years, bring in $1000 USD or more.

If you are still serious about considering the risk - you should seek advice from a criminal attorney in your area who is familiar with the laws, ramifications, and outcomes. They may even have advice about what you can do which would not run you afoul of the law while being able to create a game.

I dont encourage or deter you.. but want to pass my observation. I am following many hentai-twitter accounts.. i dont know or speak indonesian language but I become used to identify the language,. and many hentai accounts I see are from Indonesia, for example if the hentai has hijab (the head cover) I am sure it is from Indonesia. And hentai artists from Indonesia are popular.. some have over 100k follows and they have post their comics regularly like every Monday or Friday.. And they have a pay system, there is an Indonesian version of Patreon.

From what I see, Phillipines and Indonesia are the countries not from the West or Japan, that have many hentai artists who sell their work. My conclusion is it is possible from there, but you must be careful.. Maybe this type of artists hide their identity online and if there is a bad sign, they can disappear immediately.

I also agree with Count Morado. This forum is not the best place to ask.. it is a good idea to ask the hentai artists from Indonesia on Twitter. Because they are from your country. They know more about this, after they answer you, you can consider it. This forum is only good when you have already have a game to promote/upload or if you want to play a game.

Yeah, there were a few significant fictional porn creators that I knew of, and they are Indonesians that live in Indonesia. One particular guy that has made a few solid rounds on the block is Krekkov, and he's not only pretty open about being in Indonesia; he's also pretty open about what kind of porn he made. In particular: gay porn.

I also agree with Count Morado. This forum is not the best place to ask.. it is a good idea to ask the hentai artists from Indonesia on Twitter. Because they are from your country. They know more about this, after they answer you, you can consider it. This forum is only good when you have already have a game to promote/upload or if you want to play a game.
How do you ask them, though? Like directly DM them or something?

I got somewhat of an answer from Krekkov's manager. They said that he:
- Doesn't use his real name (obviously)
- takes little / small amount of commissions due to tariffs
- He even refuses some comms due to factors

So pretty much just skirting the law by not making too much smoke.

Probably the question is: how much would attract the government's eyes? For clarification, the average monthly income and/or labor wage is roughly $200 USD in Indonesia. Pretty low for the USA but just enough for Indonesia since our economy power is 3rd world level.

There are many questions within the question you are asking. If you use Patreon, Patreon reports income to many countries for tax purposes.

If you make a game that some people like but you piss off someone who knows you're in indonesia, there's nothing stopping them from reporting your account (no matter what platform you use) to authorities in indonesia.

How about if somehow someone gets access to the computer you are making the game and finds the files? What about if someone in indonesia has the game and gets nabbed for something else but authorities find the game - and they're willing to rat out that they know the game was made by someone in indonesia and gives authorities info about how they got the game, etc and what your social media accounts/discord are because they follow you online?

What's the likelihood you are going to get caught? Most likely very small - but that's pretty much the same for most people who do stuff illegally, from speeding to doing drugs to shoplifting, etc. That's the risk, isn't it? And is it worth the risk? Also, again -- the average is $100 USD per month. The median is actually slightly less than $100 USD per month - after 3 years of hard work. That means half of the creators on Patreon earn less than $100 USD even after 3 years of doing it. You'd be better off getting a traditional job and working there 3 years.

Finally, and returning to the advice I gave initially - if you TRULY want to know, you NEED to talk to a criminal attorney in your area. Asking anyone else does you no good because they won't be the one with their ass on the line if you get caught.

But they are still taking a risk. They could get caught any day. They may never get caught. But they are still taking a risk. They are breaking the law and they've made the decision, based upon what they know to take the risk.

And I just looked up the punishment for a conviction of creating pornography in Indonesia: It is prohibited to produce, distribute (etc.) pornography which explicitly contains (sentence minimum 6 months, maximum 12 years, and/or fine of 250 to 6000 million rupiah).

Is even the small risk of serving 6 months to 12 years in prison and possibly paying a fine of $16,000 USD to $375,000 USD a reasonable risk for maybe earning $100 USD per month after 3 years of working on a game? I mean, that's not even a US prison -- it could be Kerobokan Prison, overcrowded and underfunded with people who committed even worse crimes than making a game. You'd be everyone's date on Saturday nights.
