Demo is literally just play 2 games of rock, paper, scissors with (or unless I missed it) no reward. It wants you to subscribe to their patreon for the full game.

If Nintendo claims this it's because it's using assets from Super Mario 3D Land, New Super Mario Bros., and Super Mario All Stars for the backgrounds and UI. Not to mention the various stolen images probably ripped from Gelbooru or whatever.
