Greetings, everybody!
I am writing this text with the help of a translator, so please do not judge strictly. (DeepL.com)
My plans are to start developing a game for adults based on the MARVEL universe, namely the story about Spider-Man.

I have some questions:
1. What can I do to avoid being sued for copyrights?
2. My plans are to focus on the story, its semantic load. I don't want to do a stupid game about uncontrolled fucking. Of course, the sex will be there :)
So the question is, is the community ready to accept such a game? (With great emphasis on the plot)

1. Easiest is not to use copyrighted/Trademarked materials but since you are going for a Marvel based game that might be a little hard. I do think the chances of being sued are low (but not zero). A cease and desist letter seems more likely if it gets on their radar. To limit my exposure to a law suit I'd make sure the characters don't look too much alike to their filmic counterparts. As people might object to being put into a porn game. Otherwise the porn industry gets away with it by making sure their knock-offs are parody. Look into that. It is part of the the fair use clause under US law and may have counterparts in other countries. I don't know how you can make it more likely to fall under a parody. (It is an affirmative defense so it can only be decided in court whether or not your product falls under fair use).
Also don't use any background images you don't have the copyright/licence for. Photographers seem rather happy to sue lately. There are enough free backgrounds out there that you'd be able to use (search for public domain or cc-by licenced pictures if you need that).
2. Their will definitely be an audience for a more story driven game out there. Basic rule of thumb is if you make something you would want to play yourself there will be others that want to play your game as well. I think quality is a bigger driver for success of an adult game rather than the amount of sex. (Just make sure not to fall into the trap of not cutting scenes down to their core because you are writing a story based game).
3. Looks good! (but I'm not into super hero movies/comics so maybe the the person to ask).

A little off topic. I liked your sketches. Tell me, are they made by one program or processed by several? If one program, which program are you using?
