Dear Friends,

I'm writing this entry to inform that Xhamster and Xvideos are demanding an explicit permission, from the developers, so we can publish gameplays of their games.
Just for your info, I'm always commenting my gameplays (narrator voice, characters voices ... ) but there are many other that only are uploading the gameplay without any comment.

For now, Youtube , Dailymotion and PornHub aren't demanding any permission from the game developers. Do you think they could do it on the future?

And now I'm asking:

They have any right to demand us a permission for the upload of the gameplays?

How can we respond them?

How can we get the permission from the developers?

Please help me (and many others) with this topic!

The situation it's getting really awkward. They don't give us any info, only generic responses. I Had circa 4 million visits and now I only have 1.4. In xhamster they directly blocked the update of videos if you don't have the permission. I just don't know how to get all those permissions.

Totally. While it's, legally speaking, a grey area, you're showing content you don't own the rights on. Therefore, it's natural that they ask you to prove that you have the authorization to do so. Legally, their own responsibility can be engaged as accomplice if they do nothing ; and like they start doing something, I guess that they recently had some trouble with that subject.

How can we respond them?

It totally depend of the relation you want to have with them. If you want to be thrown out of their platform, tell them to go fuck themselves. But if you want to continue to use their platform, I recommend to respond politely, saying that you are sorry, didn't thought about that, will contact the author(s), and stop publishing those videos until you received their agreement.
Always play dumb, but not too dumb ; don't say, "I didn't know", if it's explicitly wrote on their Terms of Use, by example.

How can we get the permission from the developers?

By asking them politely in private. I'm sure that 99,99% of them will agree ; it's free advertisement after all.

I already got johannes89 permission of a few of them, they usually agree if you comment the video! Maybe will make it work somehow. Maybe we should do a list with the developers that accept to do gameplays.

I should really integrate that somewhere on the first splash screen of the game

For ones that do transformative stuff (so they're reacting to it, talking as they play, etc) I'll also offer to host a snippet of them playing the game inside the game, with a reference to the game itself, similar to this:

I never created a Let's Play before but I would also suggest uploading your videos to other platforms as well. The sanitation of streaming sites is getting out of control.

I'm not sure having it as the first splash screen is the best option, as I doubt the majority of your players will be streamers that care about the legal stuff. Definitely add an "about" or "legal" section to the main menu though, which will be easy to find and show.

They have been removing a lot gameplay footage from f95games on their site. I always wondered what was going on and now i know thanks to this thread.

Interesting question...

I suppose solution may be in legal disclaimer at the very first screen of the game. Developer just need to mention he grant right for gameplay to anybody. Imho.
