Images of Real People/Celebrities

Just how "Okay" is it using images of actual people in games. People like celebrities, sports stars, Olympic games athletes, porn stars, ect?

There are a lot of real porn games here, I'm not sure about Patreon. I just got a popup on Patreon saying they want age consent forms or something for all images of persons.

I'm asking because as a non-artist and beginner, using random pics from google or specific celebrities is my main best option at the moment.

More or less, real-porn is on a downward trajectory. Provided a viable competitor for Patreon doesn't come up out of nowhere, and even then, the same will eventually happen to said competitor. Cryptocurrency is really the only future for adult games, but even that's going to take a while.

It is 'okay' to use real images. You are unlikely to be sued by an actress or agency representing them (worst case would be a DMCA takedown/request.), and you'd probably be fine on Patreon for a little while, but as your project grows, someone'll get upset about something in your game (NTR or something equally divisive) and report it. That'd spell the end of it. SubscribeStar may be the better option for you. If you're just in it for a bit of fun and not the long-term, then sure, have fun with it and maybe make a few bucks on the side. But if you have the computer and parts capable of it, I'd really recommend looking into Daz and Ren'py (or Honey Select and Renpy). You don't need to be an artist or programmer for either (writing may be a different animal, though.), you just need to some free time to watch some tutorials and learn the programs.

With regards to legality, I'm not a lawyer but it obviously depends on jurisdiction of the dev, the platform (e.g. Patreon) and maybe also the end user. If I would have to guess, I'd say it's generally probably not legal but maybe somehow tolerated.

With regards to ethics, adding random people or people who happen to be famous because of their occupation (e.g. athletes or businessmen) to a porn game is a big NO from me. Those people didn't ask to become famous and certainly not to star in something that may be objectionable. With porn stars, I have less issues, because they already willingly put their content out there. It feels much less as a privacy violation to me.

Even though I play porn games, including those made with real pictures, I would not lik to encounter myself in one.

You have commendable ethics. Here I am, wishing for someone to make a real porn game with all the deepfakes and cfakes lol. Kpop is a gold mine. But maybe their fandom will come and burn down your house.

Also not a lawyer, but this has been asked and answered many times already. From what i understand, it generally depends on monetization. If you will receive no money for it, then you can likely claim "fair use" (no guarantees about real people though). But since you are asking about Patreon, then i'm guessing money is in the picture and then, technically you would be breaking copyright law (at least in the US) if you use the images without explicit permission.

The real question is even if you break copyright law, will there be consequences? It depends. If you never attract attention, then probably nothing will happen. If you get attention and they see you're a nobody, they'll likely just have your work taken down with a cease and desist. There's always a risk that worse things could happen if you are unlucky enough to attract someone on a mission though.

I think it's going to be a big legal mess when deepfakes become mainstream.

The same already happen to the said competitors even those that don't exist yet. What Patreon ask is just what MasterCard is asking them to do if they want to keep them as payment processor ; ensuring that any real persons depicted in porn content have the legal age and are consenting. It raise some issue regarding the privacy of the models, but for once it's not a totally fucked move.
