I've always wondered how ownership of such intellectual property works in cases like this. The dev has obviously gone, but at the same time it would still be considered theirs. However it's also using pictures from the internet which they may or may not have licensed

Pretty much yes. It's stopped. If you check the lad's patreon it's not even there anymore in any capasity. So it's not just paused, it's gone. There was talk the lad was ill so maybe if he got better he'd come back but given the patreon page is gone it seems pretty final. If you were hopeful of coming back you'd leave it up but just pause payments. So yeah, it's gone.
can another developer take over the project?

As I mentioned above, I'm not really sure of the particulars. I... suppose? Although statistically speaking it'll come to nothing. In cases where a game is taken over, there's usually a discernible dip in tone and quality which leads to it ultimately being abandoned again.

I think that's part of it. Anyone who takes it over won't have the exact same vision or style and that leads to inevitable disappointment. And anyone good enough and motivated enough to do it is probably working on a game of their own. This dev's former project, Bimbo Life Coach, did get taken over by another dev and reception of the more recent updates haven't been great, and it's now not had an update at all for around a year.

Yeah, Bimbo Life Coach was fun. I appreciate games where the devs try something new.
Really I think the best bet would be to learn up and make your own game. You can be "influenced" by games, perhaps even steal plot lines but it'll sit better if it all comes from the same person, from the ground up. Lexi/Hillside being an example

There's a thing he did in BLC where you'd play scenes over and each time it would reveal a little more. Did the same thing in this with whoever Diamond Jackson's character is, or with Kenzie Reeve's character. The way this happens with the Mom corruption in BLC is one of my favourite bits in any game. But, like you say, things like that are kind of hallmarks of a creator with a certain way of doing things, and while I'd be really happy if someone took this over...it probably wouldn't be the same.

I get it, the game could turn out like those series that are successful at first and then the director changes and it's completely different.

I'm going to use the term Author to represent the project's Developer, because there are other Developers involved.

There are (at least) three parts to the project that need to be considered:
  1. The visual media included with the project, whose copyright is very likely held by someone other than the Author.
  2. The SugarCube story format that supplies the core functionality of the project, whose copyright is owned by SugarCube's Developer (a).
  3. The Textual and Code content written by the Author (b), which they hold the copyright for.
It should be obvious that if "you" include the project's visual media in a remake of this project, then "you" would also be breaking copyright the same way that the current Author is. But that choice is "yours" to make.

The SugarCube story format is released under a licence that allows others to use the engine as is. The only concern would be if "you" tried to release "your" own copy of that story format engine and tried to make out that it is "yours".

The Textual and Code content written by the Author is where things become legally an issue, because copyright laws are not the same in all Legal Regions. So where "fair-use" may be argued in some Legal Regions, as long as you meet the minimum requirements for such. Other Legal Regions may not have "fair-use".

And I don't know which Legal Region either the Author or "you" are in.

(a) the SugarCube story format includes code written & released by other Developers, but from memory the licences those other Developers use are compatible with the one that Sugar Cube's Developer uses.
(b) Some of the Code content written by the Author may of been obtained from sites where people like myself post solutions to technical question. But generally such code is given freely without copyright being applied.

I asked the creator a couple of years ago if he was okay with fan fiction for the game, which he seemed very happy to agree to. You might, if you were optimistic, extrapolate this to him being happy to have someone make a continuation of the game.

Well I hope the dev is alright, That's pretty sad indeed. Like his previous game (Bimbo Life Coach), I hope someone would resume the work but how sad (these two games have great concepts after all, it would be awful to let this one disappear but I'm not good at coding ^^')

ridiciolous what a company thinks these days ... but if the majority of creators accept it what will u do ^^ instead of looking for another site who has no censorship applied like patreon ...all are using the snitch site xD kinda sad and funny at the same time...
