I believe that games that aren't marked incest, but have incest patches are games that are forced into incest by patches made by people other than the developers of the game. These patches usually hit the game in question with a hammer forcing paths and connections that were never intended.

Edit: It's also possible that these people that "aren't the developer" actually is the developer trying to get around things.

It's not totally impossible.

Tags are defined by the thread owner, when the thread is created, and according to what he know about the game. What mean that there's generally tags missing. It's then the job of the community to report the thread, explaining what tags are missing and why they are missing, for them to be updated accordingly.

There are games that have forced incest.
But the games I came across: the incest dialogues were already present in the scripts, indicating that the developer intentionally included them in the game.

Because so far there's no incest in the game. It's hinted that there can possibly be some, with MC's mother, but also sibling incest among the side characters, but nothing happened yet.
