Edit: nevermind i found them. One is held by a crab in the map screen, one is in the BG of Radical Park and one at the lakeside by using the camera, one is in her ear with the ear tag in the first pose, and the last one was in the midna helmet in the standing pose

The character and the like may not be original, but creating the game is. They had to draw each scene, animate, voice, etc.

And yet they cant market it openly without the fears of getting sued by the holders of the actual assets. Did they bought the rights for these characters? If yes then its ok if no then piracy is totally justified.

Sure it's not there characters and I was never saying they were, but someone still needs to make the game. They still have to draw, animate and program the game. It's still there work even if they don't own the characters.
Also I could be wrong, but this might count as fair use. The game doesn't use any original assets, doesn't use any trademarked names and it isn't anything like the games those characters are from. So as fare as the law is concerned (or at least I think so, I'm not a lawyer), it's an original work.
