He'd have to do something that would really piss Nintendo off for them to take legal action. Look at Palworld, they have designs that are "heavily inspired" by various Pokemon and many artists and designers did comparison shopping between the 3D models, some of which fit perfectly and others with slight variations. They only took legal action when Palworld talked to Sony about selling merchandise like plushies, which is where Pokemon really makes its money.

This looks like the most unique and high quality R-18 monster collector/fighting game I've seen so far, at least from the pics, hopefully the gameplay lives up to it.
