You aren't paying for the game, you are helping support the creators. Patreon isn't a game market like steam or epic where you buy the game, it allows you to fund people doing stuff.

Not exactly sure how effective of a defense it is in court.
It doesn't really matter as unless a dev is making 6 figures on Patreon it probably is not even worth it to sue. Exactly almost nobody on patreon is making enough for a company to sue them. Lawsuits cost a lot of money so there needs to be a lot of benefit for winning or a lot of harm in doing nothing. As well stuff like this with online copyrighted content has not been tested in court much for a reason. Nobody wants to set a precedent and there is too much at stake so everything gets settled every time.6 figures, lol. I've barely made any money so far...
