Seems more like the second.

The Patreon link goes to NDC's Patreon, the itch link indicates it's motherpaf201's itch page but it also links back to NDC's Patreon so it at least seems like the developer isn't stealing without attribution, though it's an open question if the developer is building a VN from one or more of NDC's comics or if they are working directly with NDC.

Even if an artist puts art out for free they still have a copyright on it, they are effectively letting anyone access it using a general license (a lot of websites will require uploaders to agree that their works are distributed using a specific license, e.g. Creative Commons). Depending on the artist and the website, the work can be posted under licenses that allow unlimited copying and viewing of the work, but do not give a general public license for derivative works or commercial use. Whether or not the dev is licensed to use the work in the way he has is a question that can't really be determined without more details about what license the dev was granted to copy the works.

Talking about what the game is actually about (Or rather the hentai part of it). It's basically a collect photos simulator.

Since the author didn't pay the artist or even worked with him to make the game (or at least that's what it seems), he just took the images from the internet (twitter, rule34, etc) and made an rpg with it. As you can expect those type of images don't really mesh together to make actual scenes like in a normal hentai game. What the author did to "solve" it was to make the MC go around getting "photos" of the different girls instead of actually fucking them.

So yeah, while all the art is from the same artist there are no real scenes except one or two (when the author managed to get an actual set of images) and it's usually with whatever protagonists the artist put in the original picture (Like Rinko from Gundam and his son Sei).

Also the time mechanic is awful and the dialogues need work. Still...better than I was expecting (Which was your typical shitty rpg with stolen pictures from google images).

PD: Take in mind that I don't know if the art is stolen or not, only that the author isn't the artist. For all that I know the author could have asked for permission from the artist and got the "Okay". What is 100% sure is that he's not selling the game (at the moment it's free at itch.io) and that he referenced the artist and even put a link to the artist patreon (the only patreon link at that). So the author shouldn't be getting any money out of this.

I played this game in "newgrounds", I don't know if the version of newground changes with this one but in newground there is a bug with the mother in her room that always repeats the same scene. Preventing you from going to your room to spend the hours. The game doesn't seem to get any money from NDC content, because the itch.io patreon leads to the NDC one
. Apparently he's just creating a story with NDC art. What I wonder is how he will do when there are sex scenes. Since there are NDC characters that still don't have scenes made by NDC.

Despite hating ntr, I kinda like ndc's Natsumi and Ban. I think it's because despite Natsumi being an easily manipulated slut, she still adores her son more than anything and loves to have sex with him, and also that Ban seems to be aware that his mother is a slut who can't say no so he emotionally distances himself from her. Not sure if ndc has anything to do with this game though.

I did notice an issue where after putting in the code to access the cosplay pictures, the code seemed to set the time to that large 6 digit number which effectively messed up the whole day/night cycle
