1. shrug. they don't know what they are talking about either. calling a biological mother carrying her own child a "surrogate" is just stupid.
2. according to your link both sides of the argument are wrong.
as they describe surrogacy where no sexual intercourse took place (contradicting the other side), but the so called "surrogate" is the biological mother (contradicting me).
It doesn't really matter, does it? You understand exactly which one the original commenter meant.
More importantly, the issue isn't how your MC feels about it, but rather how you feel about it.
The MC might call it a surrogacy, you might call it simply having children with someone else for contrived reasons.
As you have no say in this and presumably you also don't have a cuck fetish, it's very obvious how it could be upsetting.

What do you think gay couples call it when they use a woman to bear one of their children? It's still surrogacy.
The kind you're talking about has only existed since the 80's. Surrogacy as a concept has existed for centuries.

As for the court battle... yea, the big court battle over the so called "traditional surrogacy" determined that:
1. the so called surrogate is actually the mother.
2. custody goes to the biological father because of the contract between the mother and father saying the father gets custody.
this is a big reason why real (gestational) surrogacy is so popular.
because in a real surrogacy a woman carries a test tube baby that she is not the mother of.
