I don't think any corporations actually care if they thought they could get away with it. All corporations are greedy cowards who stand for nothing only gaining as much money as possible. So they did a calculation on how they can push it as far as possible without risking government intervention or moral outrage. Some game devs in other countries are already going to prison for their content. Happened in Australia to one guy I heard about. Although he pushed it pretty far. A lot further than this game.
He's an exceptional case though. I'd be very surprised if he wasn't the first normal human that is getting close to them, that's certainly how it sounded when we met them all. Assuming that Pepper isn't a mutant just because we don't know what her mutant power is yet doesn't make sense to me.

My theory is that her real hair color can change colors, like Yuna, depending on the light intensity. She keeps her hair black to avoid drawing unwanted attention.
