I see where you're coming from with this, but it's still a pretty big stretch. I don't think it is anything more than wishing happiness between two people she knows and has grown close to. If you end up on Kaylah's path, you're not on Charlotte's path, and vice-versa, so the most you'll get is a Kaylah path where Charlotte is happy for you both. That's very different to anything cuckquean-y. I love a good cuckquean character, believe me, but this isn't the one.

If you say yes to Kaylah (like I did in this playthrough) is that "her path" from then on? Because it sure seems like Charlotte path, but maybe that's just because the game hasn't progressed far enough to see the ramifications

Charlotte is close to you on every path, just by the nature of your continued proximity and impact on the family. It's a monogamous game though, so there's no path with more than one woman on it. You can go only so far before one decision or another with lock you onto a path, or block you from another path.

IIRC there are four paths, one for each Lloyd woman. Kayla and Agent Fox are side girls who you can get lewd with regardless of which main path you are on, but doing so may or may not have repercussions with the Lloyd you are romancing.
In regards to Charlotte seemingly approving, this game is written so that the story conforms to the MC's choices. What I mean is, Charlotte doesn't start having serious thoughts considering being with the MC until AFTER the player chooses whether or not he is attracted to her. If he chooses to remain professional, her path doesn't start and she'll still slowly heal on her own but she won't be jonesing for the MC. Same with Lucy, at the scene where Lucy is carrying Charlotte back from the event where they have the first new incident with Jason, you can tell Lucy that she is worthy of love, but the real choice is at the end of the scene when you choose whether or not to say you will be waiting for her when your job guarding Emma is done. If you don't say that you aren't on her path and her internal monologue is disappointed you didn't choose her but is hopeful that you and Charlotte will get together.
With all that in mind, if you choose to be FWBs with Kayla, Charlotte will be supportive. But if you reject her, Charlotte is annoyed that Kayla even made the attempt. Her attitude is based on player choice, its a thing I've seen in AVNs a few times before as way to make it so that there aren't "wrong" choices, I think. Like the "where to cum" questions, whichever you pick is what the LI screams out for, just on a more plot-wide scale.

She is a side character as far as I know but I hope things change as the last update with her it felt like she could be going towards more than a side characterHuh, I figured Kaylah was a side character and couldn't lock you out of a 'main' route. Ah well, not that sort of game.

Charlotte will be supportive while still staying on Charlotte path? That's the wildcard (and the thing that has cuckquean aspects which made me curious).
I do see an older comment that suggests it's possible to reject all the Lloyds, which could be functionally a "kaylah path" even if kaylah is a side character. Though I hope if that's the case, it's more clearly conveyed that saying yes to Kaylah is turning off a lot of main girl content.

Unfortunately dev confirmed only recently that only the Loyds will be LIs.
Kaylah, Fox and the two girls to remain side pieces.

yeah but things can always change over time and won't ever make it to full LI status but could become something a little more than a side girl with an ending. At least that's the impression I got from her in the last update
Thats a good question, I am sure there will be some kind of reaction and it probably won't be a positive one.
But I try to avoid that kind of conflict usually so I've never accepted Kayla's advances while on the Charlotte path. Good luck with that though!
