Is it legal to create and sell 18+ 3D animation or VN's on Patreon from India?

What if some indian create the VN and someone else from other country publish it from their account in patreon? that will be legal...money indian can get from their friend's bank account as fund and can pay tax on that ..simple.
Getting money for it isn't what makes it legal or not.
The manufacture of it is Illegal and distribution is illegal even if just one person. So no not legal money.

If the porn VN is distributed in India.
Then India would simply start with charging the patreon account owner with the crime. Which they can do though they are not a citizen of India. They could freeze that person's financials, use them to see who they are paying.

If the porn VN is not distributed in India.
India probably isn't going to look into it. However, if someone reports it was made by the citizen. Then they would simply investigate that aspect. If they find evidence to the point that the person is the developer of it and or receiving funds from a party that makes its money distributing porn then they are hosed anyways.

Technically if you are in India there is no legal means to manufacture it. There is NO 100% safe way of getting away with it.
The person who owns the patreon account is most likely not going to take the fall for you.
You won't be able to talk to anyone even family or friends about it without risk. All it takes is one person pissed at you or in need of money to report you.

Take even coming on this site asking about it. Sure the guys at f95zone probably are just going to tell them to get lost when it comes to identifying the account asking this question. However, the server this is ran on is a different company. Their head office and their corporation isn't based in TO. If they do a lot of business in India well they might want to be allowed to continue to do so.

At this point you are probably saying I'll use a VPN. Even VPNs give in when they face legal issues. You would need to use only VPNs that you checked are not in countries that have treaties with India and more. They can use their network laws to see who and at what time connects to lets say TOR. Then they check the post dates and times on the site here. Once they establish a pattern of a connection to TOR or whatever VPN and it coinciding with posts being near that time they would then just need to get a warrant for the person. The point of that is even without the VPN handing over the ID. You can still be Identified. It isn't as much trouble as most people think.

Well that's too much idk who is so much pissed off for playing VN game..and why taking so much seriousness if it doesn't hurt anyone else feelings.. it's clear message if someone doesn't like it , don't play it..why they are so much against no dont create in india, i don't understand that. anyways, there will always be some unknown names always. subscribing for viewing porn animation is legal, but want to earn money from outside india members is illegal... it's like creating india a supermarket to consume porn and not to earn by creation from other countries.

There are multiple reasons for India's choice on this aspect.
For other people in the world making porn isn't illegal. The fact their citizen goes to a website hosted in another country and watches it is on their citizen. It would clog their courts up trying to stop that.

They also have the view the person creating the porn is the bad person and the person looking at it is the person who was tempted. (victim)

They are still publicly a very conservative country regardless what people do in their privacy.
Add to the fact they have a strong view on the harm that porn does and the victims it creates and they don't want their citizens involved.

Meh idk good bad or anything.... it's not about conservative or open...there are always series running in alt balaji or somewhere else now kavita savita bhabhi etc .. there's no stopping....if they will stop more..it will come out more. There's no victim..even before internet..the cases were way more than today when it comes of harming..now people got aware so...there are always 2 wat to see coins...you can see it as negative negative way...and like gaming harm community porn harm community and block everything ...and blame it to the gaming and porn industry.....not gonna vote for this kinda rules again if i ever get opportunity..There are ways to see it.. everyone can debate for 1000 years on this if they're interested...yet population of India won't be coming down even if they block everything...anyways thanks for your point of view all i can say... people are making money anyways out of it probably and they will keep making money in future whoever wanna make..and rest of others can follow law as it is. I'm not stating if I think it is right or wrong. Just the reasoning they used.
Not my nation and not a problem for me I live in the US.
I simply stated the facts.

The view that there are victims is based on their believes and values not mine or yours.
You for example probably think it is perfectly fine to beat your rocks off looking at a game.
Well to them it is a violation of the religion and is harmful to that person's sole.
They also feel it pulls people away from having meaningful relationships and doing other stuff they should be doing to better themselves.
If you wonder what religions view it as causing harm, Hindu, Islam, Christianity(especially catholic), Sikhs, Jains ... Not all but

Generally what I see is most the Indian related porn is done outside of India.

It doesn't seem there has been any large protests over the increased strictness in the 2000 and 2008 laws.

With most people doing this simply staying out of the country and relatively few risking it staying in the country or going back and forth. I doubt it will change much any time soon. You would need significant numbers to get people to care and people not to actually see it as taboo. Most the people there who look at porn wouldn't admit it openly.
