In the UK, if you have ever acted in a parental capacity, including guardianship, then it is covered by the same rules of law as incest - which to me makes a lot of sense if the main issue is with levels of influence or the potential for 'grooming'.From a North American state of mind..if he married his wife and she already had kids..and he never formally adopted them..legally he is not the step-dad...thus..incest rules do not apply...and if he did not adopt them..when his wife passed if she left in her will that she wished him to be the guardian..incest still does not apply..SO...place the game in say...Huntington Park L.A. and blammo..he could legally boink Macy..hehehe..
(If the rule of law were based on biology alone, and the danger of inbreeding, gay incest could never be a crime, as there would be zero chance of conception or breeding).
