Copyrights for starters...
This probably dumb from me but I am genuinely curious how licensing works for porn/adult games, especially those that are funded through patreon? Is ICSTOR an independent company or more so just the creator :unsure:

Standard disclaimer that I am not a lawyer, nor am I claiming to dispense official legal advice.

None of those things has any baring on licensing/ownership. Whether he is a single person, a group of people, or a formally recognized corporation do not change what is "owned" by the generating party. Nor does the fact that it is adult content change anything in this context. Nor does how funding is acquired. The fact is, something was created and people aren't supposed to basically clone or make a derivative creation for their own profit.

That said, copyright and trademarking is highly complex. And models in these games are purchased from completely outside sources... like ICSTOR did not create the skin or hair or shapes of caroline or anyone else in his game. The more identical in looks, character, family, backstory, etc... how many things match up and how much it seems like one is trying to take another's work, the more likely someone can call "foul". Also, there are parodies, similar but differing characters, whether or not fees are being charged, or other adjustments that all change whether or not there are potential legal conflicts.

All that said, making an image (or even a whole bunch of images) is not the same thing is making a game. A storied plot, game mechanics, actual programming... all these things are completely different than and required work over the top of "being able to create better looking pictures." (Not to mention making a game is a commitment, whereas deciding to make an image when/if one feels like it requires no commitment)

Generally speaking though, take a look at this forum and see the tons of nearly plot-identical and character-identical games out there. If people wanted to combine and make a game, there's no reason to use someone else's identical family and backstory. Mix things up a bit and build a new story/world.
