It's one of those laws that people don't enforce but it's better to be safe than sorry.
For example (I believe something like this already happened): parent X found their kid playing porn game Nr.35 and because the game didn't ask for the age of the player they're now liable for the kid's "mental distress" or whatever.
It's to protect the creator from grifters basically. Like how most Porn Sites ask you to sign up or say you're over 18.
