Well his game is free to begin with, by legal definition you can't "pirate" something that its free. The dev of Love and Sex: Second Base says he comes here to hear actual criticism, because his patreons just circlejerk about the game, this is something Oni should consider as well.
I could be wrong but to my understanding Oni asks for money so he can develop the game and that's it. Again I could be wrong but from what I can tell a lot of Erotic Game devs generally go with this approach as it will get them the most people to play the game ect.

Rogue, Kitty, Professor Xavier and everyone else are copyrighted characters of the X-Men franchise, a trademark of the Marvel Entertainment Corporation, and Oni doesnt own any of these. Therefore, he can't SELL his game under any circumstance or else he would have legal trouble with Marvel and Disney. He can drawn these characters tho, under the fair use laws, since it is a parody that doesn't try to pass as the actual thing.
In this situation, Patreon works as a kind of a loophole since Patreon's terms of service states that when you support someone you aren't buying a product, you are supporting his work. Oni's "work" is to develop this game.
TL;DR When you pledge money to Oni you aren't buying a game, you are supporting his work. He can't sell his game.
You pay money to support his work, re-read my last post until you understand.

So i'm not paying for the internet, for electricity, for water and sewage and whatnot.. i'm just donating out of heartfelt thanks! I'm just pledging in the form of monthly subscription to help them keep up with their hobby.. of providing me with those things! Damn! Maybe they are doing porn actually and i should just try to fap on the bills! I probably gonna ask them companies to draw boobs on them. That would help.
His game isn't free since it is gated behind a transaction. I can copy a marvel movie and sell it on a flea market. I am selling it regardless of the legality of said transaction and the rights I infringe. If you are going to waste my time being obtuse, come up with a better argument.

Don't be dumb, those are service providers, you pay them to have a service you are interested in or in need of. You aren't neither donating nor pledging money to your internet provider, you are paying for a service they already provided beforehand.
Oni, on the other hand, isn't providing a service or selling a product, he is asking for money support so he can perform a task.
If you can't tell the difference between a service, a product and a task, you aren't old enough to be on this site.

Ok, so Jean won the Girl 5 selection poll, and I've started work on incorporating her into the game. I've got some fun ideas to mess with. I plan to get an updated visual preview for the character soon, although I've been spending most of my time lately on coding.
For those worried that your favorites didn't win this time, remember that we'll be doing another poll once Jean is established in the game, so there's always round 2. Also, for those who don't like this or that girl for whatever reason, I plan to include the option to sort of remove individual girls from play. They'll show up the first time, but then you can clear them out and they shouldn't keep popping up around the place unless you seek them out again.
As far as that goes, I'm working on the last bits of the rebuild of the game's code that I described in the January update. It's been fun going back over literally every line of the game's code and flipping it over. I found so many small bugs I'd missed the first time.
I've added a bunch of small tweaks and expansions to existing systems, and have some plans in mind for what I want to add onto some of them.
