He'd have to do something that would really piss Nintendo off for them to take legal action. Look at Palworld, they have designs that are "heavily inspired" by various Pokemon and many artists and designers did comparison shopping between the 3D models, some of which fit perfectly and others with slight variations. They only took legal action when Palworld talked to Sony about selling merchandise like plushies, which is where Pokemon really makes its money.

Ok, seems like a pretty solid demo! Very early in its development, but shows promise.

Amazing art style and neat animations, the spirit designs are pretty interesting/funny too.

Hopefully they expand on the premise beyond just being a sex scene hub.

wow this is actually really good and the pixel art is fantastic. Faster move speed and text speed, feels kinda slow. Also are you only going to fuck the spirits or humans too, humans look nice too not to mention how openly horny the all sound.
