And like peering exchange points are none-profit based, there's really no point from where you can be kicked out, unless the justice say so.
The worse than can happen is that you'll be shadow banned. But like I said, net neutrality is a reality, so if an operator start to do this, he will loose the trust of the others, whatever they agree with your content or not. And like there's always an alternative, he will also loose his customers, whatever they are other operators or individuals.
And, finally, investors are less chilly and more open minded. Hey, the owner of the third ISP in my country started in the life by owning some peep-show, and now his society offer full fiber access, up to 1Gbps with unlimited traffic, VoIP and more than 100 TV channel for €40/month ; €20/month for the same offer but on, up to 20Mbps, ADSL. His society also own one of the four mobile operators and (what was and perhaps still is) the biggest (in size) host center in Europe. So, yeah, investors are really less chilly and more open minded...
The only ones who can set the rules in Europe are the government and, in this particular case, the payment partners. And even if the government succeed sometimes (like in the UK), they failed a lot of times in countries like France, Spain or Italy, to names only three.
No, really, here the only people who can goes against a patreon-like for porn are the partners you'll choose for the payment. So, choose one who agree from the start, use a TLD operated by a society not based in the US, host your main servers in Europe and also locate your society in Europe, then you're good. No one, except the justice, can come and try to impose his moral on you.
