Fair use is a legal minefield and doesn't apply to all images everywhere ever. And it changes country by country.
you could argue that a porn game is a transformative usage of the photo. On the other hand the copyright holder could argue that the image's goal is to provide sexual pleasure and the game competes with that.
Basically if you're not a lawyer well versed in this type of thing, or you can't hire one, then you should presume you're infringing copyright.
Actually you can. I'm not in the USA and even if I was, that's something lawyers and men of law still debate over. There are some cases where it is illegal and some it's legal.

Have you even read it yourself ? Or perhaps is it a question of understanding ? All the content of this article say that you can't use copyrighted pictures to make such thing as a game which will make you earn money.
Anyway, like others said before me, this is just the US definition. On internet you should refer to the definition made by the Bern Convention regarding copyright and author's rights, and the laws which cover the photographer (so the laws of his country), and the laws which cover the site where the pictures where legally published. In some cases, even the model can take legal actions against you, especially if the use of the picture goes against its public image.
All this said, if I were you, I wouldn't have trusted the legal advice of a site with so many ads on it.
