She is not the protagonist so I really doubt
This is a game with a male protagonist...with very little choice left to Anne...
basically she can only choose to go or not to go with Martin.

She wouldn't need to be the protagonist to set the stage for what Tony (the MC) experiences and chooses to do. Frankly it would explain a lot of Anne's behavior, with how she goes from 0 to 100 with the whole sleeping with others.

I see it a bit different and of course path related when it comes to -who should begin with the "Talk" about rules-.
MC has already the sword of Damocles swinging above his head when he went the unfaithful path and even in the "Talk" didn't admit that he screwed up during their beginning of being an adventurous couple.
So in this case it wouldn't make sense for Tony to bring up the "Talk" in first place, except he yearns for the death or he tries to find a way to admitt to Anne that he cheated on her.

Only way to make Tony bring up the "Talk" is when he's faithful and starts talking to Anne how she feels about the sudden change in their relationship and that their honesty should be a big part at this stage.

The honesty is sth I missed in the "Talk", especially from MC's pov when he was already cheating on Anne.

It's still not clear to me if the rules are going to be useful for something or if it's going to be pure smoke, because I still can't imagine Anne respecting the rules throughout the story, I guess the holidays are going to be useful to see the effectiveness of these rules or Anne is not going to stab as is her custom, should I buy hats for the mc in different sizes just in case?

The introduction of the rules may be a red herring. We won't know until further in to the story. Just because something is introduced doesn't mean it is true and that is not meant throw us off. The timing as Asahibito pointed out, is odd.
