ts is inside fair use and stories are his while chars aren't.
disney etc won't test fair use in court and artists and game devs won't go to court cause it costs a lot and verdict can't be predicted so better comply to dmca.
TS' work isn't inside fair use. The characters, plot threads/stories and art style, mirror the comics to a T and is mainly a for-profit venture. This isn't literary fan fiction either, it's straight up tracing (hence the name I guess) characters from the comics. If the Mouse can sue people for screening their films for educational purposes in a school (which is non-profit, done for free) this is well beyond it. TS saying it's fair use with a weak disclaimer in the cover doesn't deem it so. It's an altogether different thing that Disney chooses to not go behind TS, or is even aware of them, at least for now.
Disney is incredibly litigious and has contested screening their films (and even displaying their characters) in places several times. DMCA takedowns are not rare when it comes to NSFW comics and games,it happened to the Injustice Unlimited (renamed to Something Unlimited) game for having a parallel art style to the DCAU, it can happen here too. I'm hoping it does.
