I've seen this guy's stuff on deviantart. His renders are high quality, but I would say his older stuff is actually art. His new stuff is just porn and that's all he keeps making anymore. The guy is also kind of an asshole. He kept complaining about his newer images getting flagged and taken down. He should know deviantart isn't a porn site. If you don't want your porn taken off deviantart, don't post your porn there. Post it here or on pornhub.

So pictures of naked fictional characters should by default considered porn? I guess that's your opinion not a fact.
If you looked more closely to why he is complaining against deviant policy simple because the enforcement seem very inconsistent and they don't even bother to explain why it gets remove or which rules was broken according to them.
Maybe they don't have to, or can afford to ignore, but I can understand the frustration.
Calling out someone as some a kind of asshole just because of that, makes you look like what you claim him to be. That's just my opinion of course.

This claim sucks, and with it the consequence would be to say that something like Playboy is art, should be evaluated on artistic merits, and not by nature pornographic, which is also a claim that sucks.
You've over-corrected the wrong direction, throwing out the baby with the bath water, and wound up ignoring the most important part festerloves post which was to really emphasize the usually aspect. Obviously nudity is used as a usually correct heuristic to determine if something is pornographic. If you go on pornhub and look at the thumbnails, I wonder if you're going to see a common theme maybe? The venn diagram of Is-Nude and Is-Pornographic in digital media are going to be hand-in-hand a whole hell of a lot. Really pornography is media produced with an intent to cause sexual gratification usually containing nudity. So if you want to be deconstructing this to art, you would have to be proving that the intent is not to be sexually appealing, and good luck with that.
It's a bad faith argument to try to split this hair and afterward define the two halves to be different.
