When characters are not villains, some people have a guilty conscience. Probably why the developer felt the need to include the dialogue that Roderick is happy without Verenna and the MC can have her.
But I don't feel so bad for Rick when I see him cowering every single time that Kate is being harassed by soldiers. The MC did way more for her, including telling Thomas to fuck off.
He can get married offscreen in the epilogue with a woman that does not appear in the game or something like that though.

yeh that did make me feel better (the saving kate from soldiers). also he kind of calls her a gold-digger later which is pretty inaccurate since he didn't do anything to actually win her over. plus with verenna you got that whole backstory about how they got married under bad circumstances.

Kate never failed in any of my playthroughs, but I never ran into those bugs either. I don't exactly know what the user is doing playing different versions though and we don't know what he did during the tavern minigame.
Edit: or if is there some fuckery going on like save edits.

I tried using different version to see if that makes a difference not sure never encounter this before I never fail Kate mini game not sure whats going on here.

I actually feel for Roderic, Verena was abused by her first lover, he was an abusive Dom and Roderic picked up the pieces but Verena had developed a kink. Sabrina had the same problem (Same guy) but handled it different. She would suit Roderic down to the ground.

...it would appear that it is impossible to win once you allow thomas to punish her...that's the whole point of letting thomas ntr kate in the first place. why would you think it's possible to win now that thomas no longer has to be fair (he was blackmailing her earlier and you had to option to tell him to stop)

That was not the case before as long as you win the mini game you would not be NTR that's the reason why accepted the term cause I know I could win the mini game. Seriously this is a bug since your pretty much force to get NTR the moment you accept Thomas terms.
Also the walkthrough mention "if you fail" meaning avoidable.
So this is an actual bug anyone knows how to fix this.

Have you tried concentrating on serving instead?
I can't tell wether the NTR plot auto triggers a failure but there is a reason the Option to let Thomas do as he pleases with Kate is marked as NTR route by the Walkthrough AND the game
