No, but doesn't need to be. For those that refuse to play vanilla AVNs the patch is better than nothing (even if it does just change the intro and leaves the MC ignorant of his family). The thing is as of 0.5 MC still hasn't fucked his mom and sisters so the incest tag still doesn't really apply (yet).

Huh? It doesn't apply at all, it's a fake patch...the tag is only there because someone made a patch, there are other games on site that "have fan made patches" where there is no tag....because the dev asked there not to be.
Again, this shit is fake and not from the dev or even dev approved...
Why does it even matter if the dev made it or not? For those it into incest even shitty patches that simpy change titles (the enitre story is a bit more work) are better than nothing, who cares who made it. Strange that a pirate site gives a shit what developers think of the tags it attaches to their pirated/leaked game. Of course if it was written with incest from the get-go it would obviously be better than a 3rd party patch, but thanks to Patreon's bullshit there's plenty of that disappointment to go around.

If the game wasn't made to have incest, it shouldn't have the tag, it's that simple. Tags are used to make search easier, not to misguide people.

I do and many incest fans do too. For instance, if you go to the here you will notice that they created a tag for cases like this because people ask for it. I myself was one of them. I prefer original stories instead of a half-baked mod that most of the time doesn't fit or needs to change a big chunk of the story to do so. Also, we have to depend on a 3rd party to play the game and sometimes wait months so they can update the patch. I play AVN for the story. If I was only interested in fetish, I'd watch some porn.
