Most companies are usually cool with it so long as money isn't involved, which a casual glance at the patreon page will tell you is NOT the case here.
Patreon exists in a legal grey area in that you are essentially supporting the dev to keep doing what they're doing. The product itself is free, with the early access period mainly being used by Cari as a way to playtest for bugs and typos and fix scenes and all the stuff he might've missed during the dev period. It's also why he's genuinely pissed whenever it leaks early (as he often views the beta releases as an unfinished product not meant for public consumption), but has since come to grudgingly live with it (attributing the early leaks as an unfortunate side effect of his AVN's popularity).

I don't imagine the game benefits much from its presence anyway. But hey, who doesn't like playing with fire?
It's outright implied in the Andromeda tapes that the "assets" floating around are the OG concepts and ideas that writers/artists/creators who've dreamnt of Eternum (note: before the existence of the nerve implant) have seen and became the inspiration for the various media that we see in the real. It's a somewhat clever subversion of "Ready Player One" where instead of various IP being brought into this one melting pot of the game, it's the other way around where this higher plane of existence that the average person sometimes find themselves visiting in dreams is the source/inspiration for all of the IP that we see in the real.

So in a way, Cari has managed to weave those said assets in the narrative, thus benefitting it. Not to mention it's a lot easier to put that idea across with existing IP instead of in-universe IP that might fly over the reader's head until the William infodump early in this update.

Edit: Then again, even if you remove the assets and go with in-universe IP he's still playing with fire given that making an AVN using HS2 is already a legal quagmire in of itself, so in case it's more of a "damned if you do, damned if you don't" situation.

I'm afraid there is no legal grey area whatsoever. Even if you are producing a free product, using ip without permission is still 100% illegal. Most companies just don't care enough to pursue action, but they absolutely could if they wanted to and the law would be entirely on their side. Honestly in my assessment there is very little risk of any repercussions, but it might be worth removing the content anyways. Better safe than sorry as they say. No one thinks much of a small risk before it happens, but they'd likely regret it if indeed some passing corpo's eyes made contact and their entire career went down the drain with a single dmca.

On an unrelated note, anyone know where this is from:

Is it just base hs? Someone's oc mod? Content from some other property? I vaguely feel like I've seen it before and it's bugging me, but my mind is hardly a bastion of reliability these days (or days past, for that matter).

Again, hardly matters when making an AVN out of HS2 and "profiting" from it, as you say, is already technically illegal as it's not designed for that kind of purpose and goes against the HS2 ToS. Same with the existing mod community of said game ripping various assets (recent ones include hairstyles from Baldur's Gate 3, for instance) and putting it in said game for scenes and the like.

Point being, if companies go after Cari, they'd have to go after the entire Honey Select community as well since that's where he gets those assets to begin with and that said modders are the ones allowing the assets to be built in with the repack copies (which AVN devs use since they have a lot of features/mods built in from the get go that help greatly in getting shots/animations for AVNs). /shrugs

Edit: Also forgot, the "legal grey area" I'm referring to is the same legal grey area that allows machinima creators (i.e. Mans1ayer) and paid modders like to exist on Patreon. Like, they obviously utilize existing IP yet I don't see them being taken down by some legal team or whatnot...so they must be doing something right or companies just don't give a shit. :unsure:

isn't that one of the in-game cops (praetorian)? looks like he made it with in game [HS2] assets

Yeah I'm just curious who made the outfit, whether it was the game maker or someone else and whether it's based on anything. Could be tripping.

Yeah, it's become increasingly clear that Eternum is supposed to exist in a world of a Platonic realism of sorts, in which the different servers are the metaphorical cave walls upon which different groups of archetypes cast their shadows. The fact that those things also appear in our world, and have appeared before Eternum, implies that the archetypes exist somewhere partially accessible to the mind. I suppose the mystery lies in figuring out when/how one can access this 'realm' (i.e., death under certain circumstances; high compatibility etc.) and how one can 'cast a shadow', so to speak. I love this sort of stuff. And boobs. So, yeah, I'm all for it.

You can complain what you want, everyone is free to do so. This is a thread to discuss the game after all. People will only get bothered if someone is actively doing a detailed search of issues in game just to bother the dev and their fans. While I don't agree at all with your points, you're still being respectful.

Just a side comment since you touched the topic, I don't understand why some people really have that need for those crusades in finding bad points in game. Every game simply isn't for everyone of course, but I don't see the point of continuously pointing out here and there what you don't like about the a game.

And this thread and people around here are actually pretty chill (way too much to the point of mods being around here to clean Off-topic), and you don't get rude answers for criticism (to a certain extent I guess), but trust me that there are other threads around these forums way more negative, where to the slightiest criticism people start to bash out everything you say, even with best intentions. It's unfortunate, but that's what he get when some people keep doing the "crusades". Maybe is on purpose, I have no idea.

Just enjoy the game, if you like it cool, if you don't then also cool. You're free to do any criticism, except about Penny you hear me? If I see you saying anything wrong rude about Penny there will be consequences.

Yeah, people here are way too chill, thats good i guess, Iam sorry if i sound annoyned, I dont feel the game is bad, is overall good, good graphics for this kinda game, the ost is kinda hit or miss(there way too many) the writting is what dissapoint me the most, but still game is its moments, the dev put way too many concepts in the game, all of them being developed without the propper writting, still think is the weakest side of the game, the characters relationship on the other hand are treat properly, every girl has its own arc, i love that, more that pls,dev know how to make you feel for the girls, is cheap but very effective

If all the words and character development aren't really your speed, you may want to try something other than an AVN. Maybe animations. Check out the forum section dedicated to them.

PS: Sorry. Re-reading, that came out a little too snippy, more than intended. I just don't get why you'd criticize a narrative for taking the time to establish characters rather than single-mindedly moving the plot along. Feels like criticizing a song because it's not all chorus, but full of bridges and intros and stuff.
It all depends on where are your expectations, i dont expect a macdonalds to be tasty healty or fullfill my stomach, i expect to be cheap
that being said, I have high expectations with the writting of this one, on the indie side, you have photo hunt, nice writting, girls has they own arc and the world feels believable, on the pro side, you have something like nanairo reincarnation, it is unfair to compare, so I dont know, people recomend me this saying this is the SAO of porn games, since is a indie game i was expecting a better writting, is not bad, but could be one of the best if you stick with the basics, at least the relationships are well developed
