Honey Select is technically a game. But in this context, you should think of it more like a rendering engine, as a lot of devs use it to create the renders for their games. In particular, Honey Select 2 is the "game engine" Caribdis uses for creating Eternum's renders and animations.

If you want a real answer, retractive TOS changes for free music libraries, and similar repository services for that matter, might not be enforceable for completed projects with no continued use of the library, but mileage may vary depending on the TOS itself, jurisdiction, etc. etc. Side note: You'd think free libraries would try to gut you in the TOS but many are hands-off. I've seen tons that aren't larger than a paragraph, so I'm surprised they added the exclusion here.
Since this game is still in development, I'd guess Carib would still be using the library/ making changes which would necessitate compliance with the new terms. If that's the case and they're planning several more updates, I can see why Carib wouldn't want to dance around the TOS when they can just swap the tracks now.
Not legal advice, btw. Need to remember to preface that.

You're right. I think he did, and thus never intended to release on Steam. Or at the very least has been aware for quite some time. As far as I know, a Steam release for Eternum has never been on the table.

Yes, the rights holders to these Illusion games explicitly haven't allowed sales since 2019 at least. It started with a shit poker trying to get Fakku to ban the use of those images at all, but they were called back by Illusion.
