The only ammunition that whinger had is the fact that while Bardie is stated to be over 18 in game dialogue, his model in the game looks at best to be a young teenager. You could make the argument that he's small for his age for whatever reasons, but it does look a little incriminating... and bringing him back would require replacing his model, redoing all his scenes with that model, all of that work before his story content could resume.
