Welcome to dealing with Fakku. That is how it always goes. Whether you are a creator or a customer they are the same to everyone.
I love your game and reading the notices you have received they have no legal ground to do anything. You aren't using their product, if you were fair use comes into play and you are still fine. Sadly Patreon is pretty quick to screw over its creators too, but I don't see that happening. What they are doing is literally illegal. They have no grounds for the suit and you could counter sue them if Patreon does take actions because of what they have falsely claimed.

I recall you stating you asked Illusion for permission prior to starting.
Simplest way out is to send Patreon a reply indicating the complaint is groundless because you use <X> package and not the package(s) identified in the takedown request and have permission from the owners. Include a copy of the email chain with Illusion where you asked about licensing and they told you to go ahead.
I can't blame Patreon from responding to a DMCA request; they need to legally. They should refuse the takedown request once you provide evidence the request is groundless.

I did ask, and I was told it should be fine if I don't sell anything. I couldn't find the DM for proof though, so I asked Jacob to give me a list of all the staff on discord so I could give him proof. He decided that no matter what I was told, I was in the wrong.
Regardless of that though, this is the CEO of Fakku we're talking about. It doesn't matter if I got "permission" from someone else.
However, Fakku still has no claim of Honey Select from what I'm aware of.

Counter claims are filed once the stuff is forced down. You want to get in front since Patreon is being kind in that they didn't just immediately yank the stuff.

We really need a torrent for this. Love the game and I am extremely happy to see more updates coming even with everything that is going on with the creator, but the game file sure is getting HUGE and a torrent would be tons of help with the download.

Lesson #1 always, always, always backup and store all correspondence where you are told "go ahead!". That correspondence is your license. If there is any chance you can still find it, take another look.
From what you've said, Fakku doesn't control the package you use and you got permission to use it. Additionally, even if someone else in a company gave it, permission is permission. Management may be able to rescind it, but there can be repercussions to them if they do and the original permission didn't provide them the right to change their mind.

Someone please upload a save file please.had to fully reset computer. I do not feel like playing through everything again up to the newest patch.

I agree the ONLY way the system would hit you is IF you sold the contents... main word SOLD which you don't LOL. I don't think and im no lawyer but I've had a gradual understanding of it as a curriculum in highschool that is if you sold a byproduct without the makers express instructions or direction then yes its stealing and that is a DMCA infringement so as I understand I hear HS or honeyselect2.0 or the like are solely free AS LONG AS ITS CREDITED FROM THE MAKERS OF THE ASSETS... and the HS is made from a whole different group unless fakku owns the studio who made HS. I've read this even in mods of certain games nsfw and sfw that this is a rule. I do believe runey you are in no danger as long as you have followed the rules and by no means am i giving my vote to those that are seemingly not saying specifically what you are doing to infringe on the DMCA by laws. as far as I can say you are good in my eyes and others should take what fakku is saying with buttloads of salt and some vinegar lol. this is also a thing on youtube so yeah others feel this pain like you. good luck to you runey keep on making this game as great as you can

Why don't they do this? It's incredibly stupid, hurts your fans, and loses them money and free advertisement.
So the question is, why am I getting a DMCA claim? It's likely I'm the only person getting this DMCA claim (so far) because I'm making the most money and it's easier to make an example out of me. However, Illusion has said they have no plans to sue or DMCA us. They mentioned they would like to do this peacefully and possibly ask for a one time payment for a license.
But Fakku didn't do this. So unless Illusion both changed their mind and fakku controls what happens to Illusion's Honey Select, Fakku seriously fucked up by directly going against what Illusion wants to do. Even more so, this seems like targeted harassment. The owner of Fakku is not happy with me and a some others. We even have proof of some harassment and it's been sent to Illusion's email.

That said, they're idiots if they think targeting the game with the highest revenue (and therefore, likely the highest fanbase) is going to do anything but bad things for them.
Since I'm not a lawyer, and the few I know don't specialize in copyright, I won't offer legal advice because that's suicidal for both you and me in the long run. I think the greatest thing in your favor is that they're looking for compliance, and fighting back may be enough to spook them off.
I'm not positive if approaching Illusion was the best idea at the moment, but either way, hopefully, they can resolve the issue before you need a lawyer.
