I'm not saying he lives off the patreon income, obviously. That doesn't make any sense. I'm just saying its weird to keep people in the dark for so long that are fans and supportive of the game to the point they give him money when they don't need to. I personally would make a post at least every couple of months to keep them in the loop even if there hasn't been any progress, just out of respect. But that's just me. Not saying he has to or that the people on patreon are entitled to it.
That's normal for this dev, when he released this in 2023 I asked how long before he abandoned this one too like his last game.

Happy New Year

Wishing everyone a happy new years and hope you've had a great time during the holidays! My new year was spent at home since we don't have any family here who could watch a toddler while the parents celebrate :*)

I wanted to provide an update on what the plans are for In a Scent.

The goal is to get IaS onto Steam. I was planning on launching it in early access with the release of the 2nd half of Episode 4 and complete Episode 5. However, credit card processors started applying pressure on Steam earlier this year which resulted in new policies and stricter enforcement, the infamous new "Rule 15" . NSFW games are no longer eligible for early access. In addition, certain type of content in these games are outright banned. You may have heard about certain games being pulled from Steam this summer.

My initial thoughts were that IaS does not violate any rules. It's a parody of certain popular genres that teases and skirts around those themes. However, Rule 15 is extremely vague and unclear. Just to be sure, I reached out to Steam support for clarity. After I explained specific scenarios from the story, they said that without a near complete build for them to review and see the context, they can't provide an answer. I asked for assurances that should I fail the review, I'd at least have a chance to rectify any violations rather than the game being outright banned. They could not commit to such assurances. They then provided further context around Rule 15, which made it clear why it's so difficult for them to commit to anything until they review the game themselves.

STEAM SUPPORT QUOTE BELOW

"For some more clarity around the onboarding rule #15, one rule asserted against Steam was Mastercard’s Rule 5.12.7. It’s only one of 484 pages of rules MasterCard publishes. Under this rule, Mastercard prohibits any transactions that in its sole discretion “may damage the goodwill of the [Mastercard] Corporation or reflect negatively on the [Mastercard] Marks.” In particular, this Rule prohibits:"
The rest of that message can basically be summarized as whatever Mastercard feels is inappropriate. Do you guys normally think about Mastercard when buying a game on Steam? I don't.

You don't have permission to view the spoiler content. Log in or register now.

So that's where I'm at. Scared of spending another couple of years developing a game that fails Steam's review. Early Access for adult games is now prohibited and I can't submit a build review unless it's near completion. Shoutout to a wonderful dev named who advised me to release IaS in Two Seasons. Pt 2 of Episode 4 is already complete with Episode 5 partially done as well. The game is planned to have 9 episodes in total. This seems the best path forward. I'll submit a Season 1 build which ends on Episode 4 and if it gets approved then Season 2 shouldn't have any issues eventually getting approved as well.

I'm going through and editing anything that gets too close to the gray area, while providing a full explanation of the entire story for the reviewer to understand the full context. Hopefully, this is enough.

I've had billing paused since October and will continue pausing it until the next update is released.

Sorry to everyone that's eagerly waiting for an update. Keep your fingers crossed that I get a reviewer with a sense of humor and understands the nuances of a parody.

How can I deliver a game without an upfront, fully detailed explanation of every single situation that's potentially in violation without destroying the nuances and excitement of the story?
Write it in tiny print at the start of the game to give Steam the escape hatch to say "hey, the game states this is all fair etc etc so we cannot be asked to ban it". Basically give them ammo.

It should be straightforward to hire a Big Law attorney to write such terms. Probably around $1k if I had to guess, if not less, and if written generally enough it could even be reused by many devs. In any event, it's worth at least reaching out to an attorney for a free consultation about the topic.

Sadly, if you have spent much time reading legal documents from even BIGGER lawyers such as those hired by MasterCard, PayPal and also Steam, you will realize that there is ALWAYS a clause that basically says: Anything we forgot to include is also included automatically. (Basically, we can do whatever we want).
Then, even if you follow all our rules, your content still needs approval.
The catch is, they decide who is approved and that has nothing to do with what is legal or not.
In the fine print they have complete legal discretion there, just because they said so in advance.
In the long run, it is much easier for them to just refuse a game. Never even give a reason and you cannot be held accountable.
They are so big, one game matters little anyway. Shoot first and never ask any questions.

Yes, but they (Steam) also charge you 100 dollars just to to get tour game on there. Then they can refuse it, and still keep your money....

IANAL but those clauses don't seem likely to carry any weight. And I'm suggesting hiring the same big lawyers they use, not smaller ones. I'm talking top 5-10 US law firms like Skadden, Cooley, etc.

Remember that the major point of hiring such big, prestigious law firms isn't just because they have the "best" lawyers - it's because they're big and well funded, and have enough manpower to just churn through motions. One of the most powerful tactics in corporate law is stalling. Big business vs the little guy means you have the money to keep paying your lawyers year after year, while the little guy will be lucky to afford a single attorney. You can just bury them in busywork until they can't keep up and have to drop it or settle.

The reason that matters little is because these corps know if you try to call them on anything legal, they will go to court and wait it out until you run out of money.
These corps have lawyers on retainer all the time. They can keep you in court for 10 years easily.
Basically just stalling. Legality has nothing to do with anything. It is all about money in the end.
Huge corps like Apple or Amazon can even lobby the government if necessary.
You are never going to win against a corp that big. It has been tried many times.
If necessary, they will wait until you get old and die. That has also happened.
Even with people who had the law on their side. It all comes down to litigation.
They can basically hold out forever. No developer has a chance.
