could have both. I don't know if that's true for this game(haven't played) but it's the usual answer.

First, I'd suggest changing your wording on just about everything to do with the lack of a patch in the op. As you've seen, the way it's worded now is gonna cause A LOT of confusion and anger from people (myself included until I read your further clarifications. Explain, that you are scared of getting turned down due to rule 7, and make sure everyone knows IN THE OP that you aren't asking for money, it will help ease peoples "dude's just trying to take our money" feelings.
Second, when you've gotten to the point that you'd need the patch, contact the mods and just see what their decision will be on the content; you never know what they will and will not allow. Games like Mau-sama and Parental love have girls that look under 12 and managed to get approved by having everything that violates rule7 behind a patch (You just host the patch on lewdpatcher instead of linking directly to the file here.) while other games that were arguably less offensively breaking the rule get shut down. It all depends on how the mods feel when they all get together to vote. If they turn you down, you just continue not posting the patch here and since there isn't any content that breaks rule7 in the base game you'll be fine.
