this points out, it might be different depending on laws and country. If you touch me while I sleep and I can#t give you consent, it's rape to me and in my country, easy as that.

Edit: An true, we might not be lawyers, but if someone would touch me like that and say it's not rape aka. acting like there was nothing wrong, he might end up needing a lawyer because I will punch him half to death after and say it was not attemted murder but just self defence.

I think (though I may of course be wrong) that when people are having this argument, they're getting too "specific" about it all. Laws are different around the world, and some of the most common countries represented here have definitions of rape that include the accused's penis entering someone else's body (which does also mean that under those laws, a female is technically incapable of committing rape). So in that "legal" respect, it wouldn't be rape, but maybe sexual assault.

Ultimately though, it's non-consensual, so going back and forth about whether it's "technically" rape or not is just splitting hairs. We're not in the legal system here, we can call it what it is without having to worry about whether or not it would hold up in court...

You can't use the None Consent equals rape argument as its both too vague, only used in certain areas and still wrong.
Even in this day and age there are alot of countries were None Consent is not even recongnised as Rape.

ACKSHUALLY:

Depends on the country. But it would be equivalent to fingerbanging/masturbation of a woman without consent as both are considered forced masturbation. However if the person has been inebriated/drugged/unconscious depending on the jurisdiction/country both may still be charged as rape anyhow due to the seriousness of the crime via "escalating circumstances" resulting in "enhanced charges."

Same goes for blackmail. It may be a situation where prosecutors seek charging as a means of escalating the punishment given the circumstances that a sexual assault takes place. For example, even if penetrative sex doesn't occur if with a minor many jurisdictions will charge the offender with "statutory rape" anyhow even if it's sexual assault instead of rape.

There is nuance to sex crime law where even if it is "technically" sexual assault, circumstances with which the crime occurs, prosecution will in some case seek to charge with a more serious charge if they feel they can gain a conviction, especially when there is hard evidence of the instances of the alleged crime(s) and circumstances involving it (battery, assault with a deadly weapon, defendant was a minor, blackmail, intentionally intoxicating/drugging the victim, etc).

So yeah, even if what happens was "sexual assault", the circumstances CAN lead to it being considered rape, especially if the person CAN'T consent by the willful intent of the perpetrator.

Legally, here only exist sexual assault (in fact, sexual assault is considered a synonym for rape, according to the law itself, although rape is not a legal term), which ranges from non-consensual groping to having sex with another person without their express consent (forcing them through violence, while they're sleeping, etc.). So, forcing a girl to give you a handjob would be sexual assault (and the same as a girl giving a guy a handjob without his consent).

In fact, there was a rather famous conviction because the former president of the RFEF gave a non-consensual kiss to a female soccer player in public and was convicted of sexual assault.

I picked randomly game from the hundreds I have downloaded, and it turned out to be good choice this time.
I liked pretty much everything on it. Girls were pretty (especially Rose, yeah, I love blondes). Well, not big fan of the boss though.

Island scheme was weird, but I suppose it'll be memorable way to get to know your daughter. I can't wait for the next update. To see how they fall in love, make babies and then you tell your daughter "Isabella, I'm your father..."
