The dev did recently change the description / information area on the main Itch page to include that massive copypasta about Chika and at the bottom even attacked those that were giving the game 1 star reviews because of it.

I myself left a pretty critical review both here and on the Itch page. And from my perspective Chika's story line is very clearly leading down a path that includes NTS if it hasn't already.
I think a good solution to fix this whole debacle would be to remove the Sex scene between the MC and Chika after learning she's a prostitute. This nullifies any relationship between them being anything more than friends, and has less of an impact later in the story when you see her coming from a love hotel with a client. I myself was quite in shock when I chose her story and to help her, and later chose to sex her only later on see her with a client. Because from my perspective the MC and Chika were more than friends at that point, so seeing her continue to have sex with others was quite shocking and is missing the whole 'exclusivity' in a haram game you normally find.
I think if the dev were to do that, then reinforce the idea of this game not including any NTR, would be better in the long run. I believe the devs of 'Goodbye Eternity' had to do something similar because the game has NTR scares but never any actual NTR.

I haven't played it yet but doesn't having sex with her take you off her path cause you failed a Test at least that's what I was told. Does it make obvious you are off her path? Cause if it does I personally don't mind since you are no longer on her path so for me I wouldn't see it as NTR or NTS at that point if you are off her path. Might be un necessary scenes depending on how her story develops hard to say till I play it and till more updates come out. But if it isn't obvious you are off her path yeah I can see an issue with that for sure.
I have no idea. If that is the case there was nothing noticeable about having sex with her and not. Which was another thing I left in my review about the choices being way to subtle.
