This includes distributing a Game Mods as part of any compilation You and/or other users may create. You further agree not to charge, accept or solicit, directly or indirectly, fees or non-monetary contributions for developing or creating Game Mods, including without limitation fees collected through "crowd funding." However, the foregoing limitations in this Section shall not apply if and to the extent such agreement violates applicable law. You further agree that You are only permitted to distribute the Game Mods to users who have purchased the Product through authorized and legitimate distribution channels, solely for use with such users’ own authorized copies of such Product and in accordance with and subject to the terms and conditions of this Agreement and all applicable laws.

Patreon's terms of use are not relevant to this discussion. The agreement is between the mod author (presumably the person who installed the Creation Kit) and Zenimax, parent of Bethesda Softworks. These restrictions ensure that Zenimax and its subsidiaries (e.g. Bethesda Softworks, Bethesda Game Studios) can use, license and sell mods made by people who use the Creation Kit which is made freely available to all users. Anyone charging money for game mods on Patreon or any other service without written consent from Zenimax is potentially violating the EULA for the Creation Kit.

correct, that is why patreon paywalling is a violation, that does not answer why the other guy thinks its illegal to pirate such mods which can be done without ever accepting the license.

Because they contain resources that are clearly not made in Creation Kit, this means they are out of Creation Kit EULA. Any meshes, textures, animations, DLL mods can be paywalled and pirating them is a real piracy. For authors this is not very different from selling their works on Sketchfab and such. We can complain only about ESX plugins but they are the least we care about here, don't we?

TL;DR
1. Authors violate CK EULA when they sell ESX plugins.
2. We violate authors rights when we share paid assets.
3. The first cannot be used to justify the second.
4. We should not care about this shit anyway.

Not any. Some authors take other people's work from other games, port it to Skyrim, and lock it behind a paywall (Kirax, Lilyrim, SavrenX.... are the first ones I remember). Yeah, it's not Bethesda's problem, but it's still a violation by these greedy modders

So? Does that lessen their guilt or what? These costumes were made for specific games (and btw, many companies forbid porting their assets to other games), not for some random prick to make money off of them

As popular they could be, I don't like these "Follower Dialogue Expansion". They don't add anything substantial to the game and some times the dialogue reactions are not well thought. A mod like "Serana Dialogue Addon" contain a lot of talk ... talk but no quest nothing important that add some lore expansion to the game.

no absolutely not. The correct legal-ish way to do commissions for any game mod or fanwork around an IP you don't have rights to is take the commission but still post publicly. The commission is incentive to make a work, not to monopolize it

decency - location dependent and copyright infringement if its actually game assets, or even just for using the IP if they can't convince the court of fair use. Ripping assets and nudifying them to use in sexual art is absolutely illegal. Making your own model of a licensed character could be protected as parody. realistically its probably too difficult to prove use of ripped assets unless you get evidence that they were responsible for a data breach but if they cared enough and tracked down the person in question the copyright holder absolutely has a case
