It is rape by real world laws but we are talking about tags or fetishes in porn so it is different. While Asuna was in VR and Inoda was using her unconscious body it would be counted as sleep sex. But there is no sleep sex tag. Rape is usually usually used for when a man forces himself on a woman and she resists throughout. I mentioned Hentai Logic of "If she enjoys it, it is not rape". It is common in corruption & NTR stories where if the protagonist is the rapist to justify he was not doing anything wrong anymore. On the Lustful Night, Asuna stopped resisting and was enjoying herself at the end. It is still legally rape but not the rape fetish people look for.yeah that to. there is also another scene, Inoda doing stuff to Asuna irl, while she is in VR. She is unconscious and unaware, so it's pretty much rape by definition.
The tags are there for people to find their fetishes so if the characters don't act like the fetish, there shouldn't be a tag. The Rape tag would work but it is not exact. It is like people looking for Netori are using the NTR tag. Of course believes on fetishes are subjective so people might not agree with my reasoning. But I wanted to explain the possible reason if the Rape tag was purposely left out.
