The very scenario was questionable and a huge grey area. Bottom line if you want a faithful relationship you're going to steer clear of questionable situations like that. Clem might have thought it was empty, but clearly didn't check for stragglers or she might have gotten distracted and a customer walked in. Which is what clearly happened and he knowing what the place is for would have thought, " hey nice, a girl is working the glory hole." The problem would have been more with Luke for not stopping it, being the only one fully aware of the situation.

The setting doesn't have anything to do with it. Obviously there are variations on the laws for it, but rape is very specific about the consent of things. Now, if the dungeon were open, and Kathryn knew she was getting into position to be used by anyone who wanted it, that would be different. She would be consenting to that. As it was though, she was only consenting to her boyfriend having sex with her, and that's all there is to it.

Yes, if you enter an operating gloryhole of your own volition, knowing full well what is going to happen, if you put yourself in the position that Kathryn did. In this instance, all that matters, is that Kathryn was told by Clem that the gloryhole was currently closed for business, and therefore she had no reason to believe that anyone besides her, Luke or Clem would be there. So regardless about what she does in the gloryhole, if someone else sneaks in and takes advantage of that situation, she's not giving her consent and it's rape.

As regards it being a porn game, and therefore the portrayal of rape shouldn't be taken seriously.
