You can say yes or no to all of the side girls. You can say yes or no and to the LI girls at every lewd scene. There are a couple of points in the story where the MC will be intimate with an LI off screen as it is necessary for the story at that time.

Realistically speaking that character isn't even an Li, so getting mad that at some point she had a fling with someone else is kinda wild to me. She is more a plot device to give insight into how much of a douche the brother is than anything else, not to mention her character and situation is quite realistic considering the setting so as of right now she is one of the better written characters in story because there is a level of depth to her goal, aspirations, relationships and overall situation.
That said I won't begrudge anyone for not liking that aspect of her character, but frankly you don't actually engage in anything with the brother unless you want to and it is explicitly mentioned that her fling with the brother was in the past and happened like only twice and back then she had no interest in the MC, every other time the MC thinks they were involved was for appearances only to make the MC uncomfortable. You don't actually see any of this happening either, it's all mentioned for story telling purposes and noting else.

I mean ... I hate NTR, I won't touch a game if there is NTR, sharing or swinging that isn't optional/avoidable but if you think that, in a harem game, one of the side girls (albeit one of my favorite characters overall) having had a - mostly bad - sexual experience before she met you is NTR you should probably avoid this game and ... most games really. That only leaves you with a very few. Yes she could have told you that she hadn't actually done anything with your brother in a long, long time but by doing so she would have been signing her own death warrant, or throwing herself into a life of slavery because the MC shows up once every six months for a week or so and is off again, so he couldn't protect her. Seriously if people are that upset by what happened they should go. There are some games out there where the MC is the only male character in the entire game - find one of those.
