well i cant buy it... i assumed its not available outside of the US... well in europe you cant buy it, or more precisely in germany (cause the law is the same for all europe i think you cant buy it in all of europe via steam or gog)
I think it might be more of a Germany thing; they seem to have more strict regulations when it comes to video games than many other (EU) countries, to the point of having to produce separate version. Like, they had a ban on selling Doom for something like 15 years, e.g.

Without getting into details, from what i can see it's available for purchase in Central/Eastern Europe; i'd presume western parts of EU similarly have no real problem with it.

Yeah, it's a German law. Most of Europe can buy it. I think the only way around it is via keys.

DPC wrote to them 4 years ago and they didn't reply. DPC must have told them in his letters what he wanted to use the songs for, because otherwise there would have been trouble from the beginning. So the band knew what their music would be used for. But at that time, the band and DPC could not have known how successful BaDIk would be. If the band had objected to their music being used in a porn game, they would have told DPC 4 years ago, but they did not.

The band no success and BaDIK success. What does the band not have because they don't have success? Money. What does DPC have because of BaDIK's success? Money.

DPC has become the cash cow that the band or one of its members wants to milk. That is the way of things in this world. Some have money and others want money.

how much do you think the band could charge for a single song?

1%, 5% of his earnings? and that would make a difference to the fortunes of the band?

okay, interesting... thanks for making it clear to me, yeah well.... germany does need an exception for everything... *sigh* its pretty paradox... you dont need to be an adult to buy even games for adults on steam or gog... every child can make accounts there without any proof of age... heck you can even watch and buy every freaking porn movie in the world without any proof... you just need paypal and thats it :D but buying a AVN on steam or gog? Naaaah not possible :D strange country indeed... it always was... but well... if politics goes on like now all over the world, we might be the only country in the future not ruled by some kind of "nazi"... who would have thought that in the past? ;) ah wrong topic in the wrong place... nevermind. Dont lets talk about that :)

Yeah, politicians suck no matter where you go. In Australia things get banned as well for drug references. But games based on sex are fine.

The world is a weird place.

DPC has used the songs for 4 years. If a court decision is made against DPC, he could have to pay the license money for the last 4 years and if necessary an extra fine. That would be a lot of money, because fines are usually calculated according to income. The higher the income, the higher the fine.

if the band was entitled to money for the past 4 years it would take it anyway (why should it give it up?), that PDC takes it away now would not change anything

Because it's so cringe it hurts. I love this game but that subreddit is full of fanboys, like 13 y.o. girls of a kpop fandom.
You can patch your current Patreon v0.8.0/v0.8.1/v0.8.2 version if you'd like to receive all bug fixes. It is a smaller 415 MB patch for episodes 1-8.
Edit: An alternative approach might be to build a modded 0.8.3 patch, which adds the fixes for season 1-2 but doesn't remove The Friday Prophets tracks. Would avoid the redistributing copyrighted music issue. That wouldn't help with season 3 & 4 though.
This is the best approach in my opinion. I'll just patch the bugs and keep the songs where they are. Removing from the patch the code that changes the songs should not be too difficult.

I don't think porn is an issue for a punk band from Sweden. I think money is more plausible. Porn is not a big taboo in Europe. In Italy, that is much more religious than Sweden, we have porn actors normally invited in TV programs for families, a famous female porn star elected in the parliament in the '80s, a very popular band partecipanting (as guests) in a porn film ("Rocco e le storie tese"), retired pornstars doing tv programs for kids (Eva Henger), we have been having softcore films running prime time on TV since decades. And Sweden is more culturally relaxed than Italy regarding sex and pornography. So it seems very strange that some Swedish guys were scandalized by a simple and vanilla porn game.

it has already happened in other AVNs, bands do not want to be associated with porn games

porn games have even less appeal than real porn

if you think of porn you think of porn stars (with their lights and shadows), if you think of porn games you think of troubled men masturbating in their parents' basement

then it is logical that if DPC were willing to pay for the rights they could get away with it (subject to the question of how much an AVN developer could ever pay for the rights to a song)
not even DPC can afford parasites living off their backs

In my opinion, DPC just quickly inserted replacement music and didn't have the time to look for a suitable replacement.

Didn't try the patch and the new songs, guess the feeling will be weird, too.

And I guess he took what was available in a hurry, or perhaps songs he had in reserve for Ep9 and on, instead of having no songs at all.

The song(s) were listened under a free commercial license, so they can't claim money for the past period (even if they argue, they made a mistake when uploading the songs and choosing the license). So it's irrelevant, how much DPC earned with the game i the past.

From the moment they removed their songs from the site and/or changed the license, they are able to claim royalties for their music. Maybe they don't want the song in an AVN or wanted money for the future use and DPC wasn't ready to pay for, we have to live without their music in the game (at least in the new and patched versions).

So the playlists need to be updated everywhere, when they decide not to be in BaD, they shouldn't be on any playlist there were on actually cause of BaD.

It's unfortunate that it happened, but it's not like it was imposible to predict, Leap of Faith, Summer's Gone and Artemis had exact same thing happend to them. Lets just hope that more artists/bands won't do the same, cause i heard that Emily Ventre and Meizong were also not thrilled about their music being in a porn game.

The band's problem is that the songs were commercially usable and the band has only now changed their terms of use. As a result, they first have to give DPC the chance to remove the songs so that he no longer uses them commercially, because otherwise any court would rule against the band.

The band probably hopes that DPC will continue to use the songs and pay for them. If DPC acquires the licenses now, perhaps the band could sue to have DPC demand the License payments for 4 years.

DPC, I think I read, has no problem paying royalties and can include them in its fixed monthly costs. But if the band demands License for several songs and for the last 4 years, I personally would give them the finger, no matter how much money I had.
other than that they are all your assumptions again of what they would have asked DPC for (complete with evil plan as if DPC was the last of the dummies), but mostly it is not true

DPC was aware that they might not be favorable, and sought reassurance, then having received no response proceeded anyway

the conditions haven't changed (DPC doesn't say, where did you find that out?), only now the authors have responded to him and told him that they don't agree with his use of it

that a song is free means that you don't pay for it not that anyone can use it, the authors always have the final say.

then it's believable that by paying they would change their minds, money suits everyone, but it's just castles of cards, in my opinion there's no basis at all, no AVN pays, assuming DPC paid it would be pocket change that wouldn't make a difference either way

let's say even 5% of what he has earned so far (which is a huge unlikely share) we would be talking about 15,000€, you don't even pay the lawyer

When I downloaded their songs from Soundcloud, they were uploaded with the CC BY-SA 3.0 license, making them free to use commercially, but this usage wasn't what they intended.

I reached out to them four years ago about using their songs, and I got my reply this week asking me not to use their music and to remove anything I had added since.
